L RESOLUTION 10q 4j ^ BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: ✓�f.`y THAT the Mayor of the City of Lubbock be and is hereby authorized and f directed to execute for and on behalf of the City of Lubbock supplemental agree- ments with all property owners dedicating right of way property along Frankford �f Avenue from Loop 289 Northward to the North city limits; said right of way being for farm-to-market road.:F. M. 2528, authorized by Minute Order No. 53016 of the Texas Highway Department dated June 28, 1963. Such agreements shall be ,i spread upon the minutes of this Commission and shall constitute and be a part of this resolution as if fully copied herein. Passed by the City Commission this 9th day of January : 1964. Steele of Lubbock County, Texas; WITNESSETH 1. THAT in consideration of the benefits accruing to both the City of Lubbock and Weldon R. Steele arising out of the dedication for public use of cer- tain real property described ;in a Dedication Deed from Weldon R. Steele to the public for public use forever, subject to certain conditions set out in such Dedica- tion Deed, a copy of said Dedication Deed be incorporated by reference herein and made a part of this agreement for all purposes, the City of Lubbock and Weldon R. Steele do hereby agree, in connection with such Dedication, as follows: A. THAT Weldon R. Steele, be allowed to use for agricultural purposes of the land dedicated herein and described in the attached Dedication Deed. Such agricultural use shall not interfere with the operation of such property for public Use intended by such dedication. B. IT is agreed and understood that if Weldon R. Steele should be asked to by the City of Lubbock, abandon any irregation well located in the right-of-way dedicated herein, that the City of Lubbock will reimburse Weldon R. Steele for the re-locating of such irregation well, if any, and for the moving and re- installation of all equipment in connection with such irrega- tion well. C.
