Ellis, deceased, dated October 18, 1949, made provision for a bequest to the Lubbock Cemetery Association of the suss of $250.00 for the purpose of maintaining a cemetery lot used as a burial place for one Temple H. Ellis, husband of the said Elizabeth S. Ellis, deceasedr and MEREA5, the City of Lubbock took over the ownership and =anagement of Lubbock Cemetery Association in the year 1848 and presently owns and operates said cemeteryt and WHEREAS. the remains of the said Temple H. Ellis were heretofore removed from the Lubbock Cemetery Association property with the result that there is no cemetery lotto be maintained as provided for in the will mentioned asbover and WHEREAS, the City of Lubbock is desirous of disclaiming any interest or rights in the Estate of Elizabeth S. Ellis. deceased because the legacy to the Lubbock Cemetery Association has laapsedt NOW, THEMORE, BE IT RESOLVED by the Co.-wnission of the City of Lubbock, that Jack F. Strong, mayor of the City of Lubbock, be and he is hereby authorized and directed on behalf of the City of Lubbock, to execute, acknowledge and deliver to the duly qualified representatives of the Estate of Elizabeth S. Ellie, deceased, an instrument whereby the City of Lubbock disclaims and releases any and all interests in and to such estate for the reason that the legacy in said will as heretofore mentioned, has lapsed. Strong, and in accordance with the terms of a resolution passed by the Commission of the City of Lubbock on the 14th day of November , 1963, for and in consideration of the sum of $1.00 in hand paid, the receipt of which is hereby acknowledged and confessed, hereby disclaimz and releases any and all interest in and to the Estate of Elizabeth S. Ellis, deceased, that the said City of Lubbock may have or own by virtue of a bequest made under the will of the said Elizabeth S. Ellis, deceased, to Lubbock Cemetery Association, for the reason that the purpose for which said bequest was made can no longer be fulfilled, and the legacy has lapsed. The City of Lubbock is the owner and operator of Lubbock Cemetery Association and as such has the right And authority to execute this release and disclaimer. ATTESTS r ack F.
