BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized and
ii directed to execute for and on behalf of the City of Lubbock a Warranty Deed to
Henry E. Whitney conveying the land described in the attached conveyance which I
�I shall be spread upon the minutes of the Commission and as spread upon the minutes!.
II of this Commission shall constitute and be a part of this resolution as if fully copie
herein in detail.

THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK
THAT the City of Lubbock, a Home Rule Municipal Corporation, of the
County of Lubbock, State of Texas, acting by and through its Mayor, heretofore
duly authorized for and in consideration of the sum of SIX HUNDRED TWENTY-
.FIVE AND NO1100 ($625.00) cash to it in hand paid by Henry E. Whitney, iof
Lubbock County, Texas, the receipt of which is hereby acknowledged, and.the
further sum of ONE THOUSAND EIGHT HUNDRED SEVENTY FIVE AND NO/100
($1 875.00) DOLLARS secured to be paid and evidenced by grantee's Promissory
Vendor's Lien Note, of even date herewith, which note is further described as
fouow s:
An Installment Vendor's Lien Note in the amount of $1,875.00, dated;;
November 1663, payable to the City of Lubbock, Texas in
three (3) annual installments of $625.00 each, together with interest
of six per cent(6%) per annum on the unpaid balance; with the first
payment being due on November , 1864, and an equal amount
being ppyable on November of each year thereafter until
the principal and interest is paid in full] said Vendor's Lien Note
being further secured by a Deed of Trust given to Bill J. McGinnis,
Trustee, for the benefit of the City of Lubbock.
Has granted, sold and conveyed, and by these presents do grant, sell and
Con Vey unto the said grantee, Henry E. Whitney, of Lubbock County, Texas, !all
that certain parcel of land:
All of Lot 5, Block 6, Suburban Homes Addition to the City of
';Lubbock, Lubbock County, Texas.
II !',('O HAVE AND TO HOLD the above described property and premises, to-
gethdr.with all and singular the rights and appurtenances thereto in anywise
belonging, unto the said grantee, his heirs and assigns forever, and I do hereby
bindnt'ei City of Lubbock and its successors to warrant and forever defend all
sna singular said premises unto the said grantee, his heirs and assigns, against
every'�person whomsoever lawfully claiming or to claim the same or any part
theregf.:

But it is expressly stipulated and agreed that a Vendor's Lien and the
superior title are retained against the above described property and premises
until said note is fully and finally paid according to its face and tenor, affect
and reading, when this deed shall become absolute.
