KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK THAT the City of Lubbock, a Home Rule Municipal Corporation, of the j County of Lubbock, State of Texas, acting by and through its Mayor, heretofore i duly authorized for and in consideration of the sum of FIVE HUNDRED($500.00) DOLLARS cash to it in hand paid by Henry E. Whitney, of Lubbock County, Texas, i I the receipt of which is hereby acknowledged, and the further sum of ONE I THOUSAND FIVE HUNDRED AND NO/100 ($1,500.00) DOLLARS secured to be paid and evidenced by grantee's Promissory Vendor's Lien Note, of even i date herewith, which note is further described as follows: An installment Vendor's Lien Note in the amount of $1,500.00, dated November 1963, payable to the City of Lubbock, Texas in three (3) annual installments of$500.00 each, together with interest j of six per cent(6%) per annum on the unpaid balance; with the first j. payment being due on November , 1964. and an equal amount being payable on November of each year thereafter until the principal and interest is paid in full; said Vendor's Lien Note being further secured by a Deed of Trust given to Bill J. McGinnis. Trustee, for the benefit of the City of Lubbock. Has granted, sold and conveyed, and by these presents do grant, sell and convey unto the said grantee, Henry E. Whitney, of Lubbock County, Texas, all that certain parcel of land: I All of Lot 6, Block 6, Suburban Homes Addition to the City of Lubbock, Lubbock County, Texas. TO HAVE AND TO HOLD the above described property and premises, to- gether with all and singular the rights and appurtenances thereto in anywise i belonging, unto the said grantee, his heirs and assigns forever; and I do hereby bind the City of Lubbock and its successors to warrant and forever defend ell and singular said premises unto the said grantee, his heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof. I But it is expressly stipulated and agreed that a Vendor's Lien and the superior title are retained against the above described property and premises until said .note is fully and finally paid according to its face and tenor, effect and reading, when this deed shall become absolute.
