WHEREAS, the City of Lubbock, Texas a Home Rule Municipality located
in Lubbock County, Texas, has determined and does hereby determine that the
public needs, safety and welfare demand and create a public necessity for
the acquisition of additional land for municipal public uses and purposes,
to -wit: for the widening of North Quaker Avenue, and this City Council of
said City finds it in the public interest and for public purposes and
municipal purposes to proceed with the acquisition of lands as needed for
such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tract
of land located in Lubbock County, Texas, be acquired for public purposes
and municipal purposes as set forth in the preamble hereof, to -wit:
A portion of that tract of land conveyed to C. L. and Suzie M. Dean in
Volume 1118, Page 667, Deed Records of Lubbock County, Texas, located
in Section 18, Block A, Lubbock County, Texas, being further described
as:
BEGINNING at a 1/2" iron rod marked "RPS 1676" found at the Northwest
corner of Section 18, Block A, and the Northwest corner of said tract
conveyed to C. L. and Suzie M. Dean for the Northwest corner of said
tract;
THENCE East, along the North line of Section 18 and along the North
line of said tract, a distance of 110.05 feet to a 60 penny nail for
the Northeast corner of said tract;
THENCE South, along the East line of said tract, a distance of 45.00
feet to a 1/2" iron rod set;
THENCE Southwesterly around a curve to the left, said curve having a
radius of 30.00 feet, a central angle of 90°06'52", tangent lengths of
30.06 feet, and a chord distance of 42.47 feet to a 1/2" iron rod set
in the East line of said tract;
THENCE S. 00006152" E., continuing along the East line of said tract,
a distance of 207.94 feet to a 1/2" iron rod set;
THENCE S. 02044153" W., continuing along said East line, a distance of
200.25 feet to a 1/2" iron rod set;
THENCE S. 0000615211 E., continuing along said East line, a distance of
94.00 feet to a 1/2" iron rod set for the Southeast corner of said
tract;
THENCE West, along the South line of said tract and the South line of
said Dean tract, a distance of 70.00 feet to a 60 penny nail set for
the Southwest corner of said tract and the Southwest corner of said
Dean tract;
THENCE N. 00006'52" W., along the West line of Section 18 and along
the West line of said tract and said Dean tract, a distance of 577.0
feet to the POINT OF BEGINNING.
SECTION 2. THAT the owners of said tract, including Suzie M. Dean,
individually and as executrix for the estate of C. L. Dean, deceased and
First National Bank as Trustee for the estate of C. L. Dean, deceased, BE
offered through the Right -of -Way Department of the City of Lubbock the
amount of $6,250.00, which is the amount appraised as the value and total
damages for the fee simple title and acquisition of said real estate
hereinabove described, for the use and benefit of the City of Lubbock,
Texas, for the purposes herein stated, and unless accepted forthwith, the
City Attorney of said City of Lubbock is hereby authorized and instructed
to institute condemnation (eminent domain) proceedings to acquire the fee
simple title to said land as hereinabove described for public purposes and
municipal purposes.
