HomeMy WebLinkAboutResolution - 1812 - Utility Relocation Agreement - SW Bell Telephone - Quirt Ave Overpass Project - 09_13_1984Resolutibn #1812 September 13, 1984 Agenda Item #19 JWF:da RESOLUTION WHEREAS, the City Council of the City of Lubbock deems it expedient and in the public interest to enter into a Utility Relocation Agreement with Southwestern Public Service Company, a public utility, in connection with the overpass construction project of the City of Lubbock in the vicinity of 34th Street and Quirt Avenue; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Utility Relocation Agreement to be entered into by and between said City and Southwestern Public Service Company, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. HENRY MAYO UTILITY RELOCATION AGREEMENT Resolution 1812 STATE OF TEXAS COUNTY OF LUBBOCK This agreement entered into by and between Southwestern Public Service Company, a public utility herein called "S.W.P.S. Co." and the City of Lubbock, a home rule municipal corporation located in Lubbock County, Texas, herein called "City" for and in consideration of the payment to S.W.P.S. Co. by the City as hereinafter set forth and the agreements of the parties hereto as hereinafter set forth, said parties do hereby contract and agree as follows: S.W.P.S. Co. agrees to relocate their utility facilities which are not located within existing public right of way for an estimated cost of $20,815.00 in connection with the overpass construction project of the City at 34th Street and Quirt Avenue. S.W.P.S. Co. agrees to procede with such relocation as soon as practicable after being requested in writing to do so by the City Engineer of the City of Lubbock, and to complete such relocation as expeditiously as possible so as to expedite the overpass construction project of the City, in any event such relocation shall be completed within 90 days of notice to procede being given by the City. 2. S.W.P.S. Co. shall bill the City for such estimated amount of $20,815.00 and any additional reasonable amounts after completion of the relocation. Any expense item which would run the total expense above $500.00 more than the estimated amount shall require the written approval of the City Engineer before the City shall be liable therefor in each instance. 3. S.W.P.S. Co. shall relocate all utilities owned by it which are located within existing public right of way at no cost to the City in,an expeditious manner, such relocation to be completed within 90 days of notice to proceed with such relocation from the City. This relocation is also in connection with the 34th Street and Quirt Avenue overpass project of the City.
