WHEREAS, Lubbock Power and Light and Water heretofore upon September 5, 1984, filed an application with the City Secretary of the City of Lubbock pertaining to establishment of a change in tariffs with regard to churches; and WHEREAS, such changes are not major changes; and WHEREAS, such rate changes will result in a savings to affected customers of the utility; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT Lubbock Power and Light and Water may implement the changes in tariff filed with the City Secretary of the City of Lubbock, a copy of which statement of intent is attached hereto as Exhibit A, as of October 10, 1984. Passed by the City Council this 13th day of September 1984. BOX 2000 LUBBOCK, TEXAS 79457 (806) 763-9381 Mayor Alan Henry Members of the City Council City of Lubbock, Texas September 5,1984 Dear Mayor Henry and Council Members: This letter is our Statement of Intent to change rates to churches served by Lubbock Power and Light, effective October 10,1984. This change will result in relief to churches who have been greatly affected by the recent change to demand rates by Lubbock Power and Light. A church's primary use of electricity occurs during short periods generally not coincidental with Lubbock Power and Light's system peaks, thereby not contributing to the costs imposed on the electric system which are associated with peak power production or purchase of bulk power. Various Regulatory Commissions, including the Texas Public Utility Commission, allow electric utilities to charge rates to churches somewhat different than those normally associated with commerical businesses. The rate is often times a non - demand, general service rate that does not penalize churches which are usually high demand -low load factor consumers of electricity. This rate will give churches served by Lubbock Power and Light an average decrease of 14.7%. It will decrease revenues for Lubbock Power and Light approximately 0.1% or $46,000 per year. It will not effect other classes of customers. This is not a major change in rates. In conclusion, this rate change will: 1) achieve fairness among customers within the General Religious Service Class. 2) is a fair allocation of revenue from the class 3) is structured to fairly apportion the cost to serve this class without imposing any additional burden upon other classes of customers. In addition to the above change we request to be allowed to delete Tarrif Number 5.0, Miscellaneous Service Charges from inclusion with our other effective tarrifs, and that these charges be set by City of Lubbock policy and ordinances consistant with City of Lubbock miscellaneous charges. Changing the process of setting these miscellaneous charges would effect customers who use those services, favorably in most instances. This procedure would be fairer to the customers who use similar services of other city departments. Overall effect on revenue would be negligible. This service will• not be available to churches or other religious associations for any structure except the structure described above. Not applicable to temporary breakdown, standby, supplementary, or to service for which a specific rate schedule is provided. Territory: Lubbock, Texas Rate: Service Availability Charge $8.00 per month First 1000 KWh per month @ 4.8 cents per KWH All additional KWH per month @ 2.8 cents TERMS OF PAYMENT: Net in 15 days after mailing date; 5% added to bill after 30 days. FUEL COST RECOVERY: The charge per kilowatt hour of the above rate shall be increased by a fuel factor per kilowatt hour as provided in current Southwestern Public Service Tariff 7100 (P. U. C. T. Sheet IV-69) . TAX ADJUSTMENT: Billings under this schedule may be increased by an amount equal to the sum of the taxes payable under federal, state, and local sales tax acts, and of all additional taxes, fees, or charges, ( exclusive of ad valorem, state, and federal income taxes) payable by the utility services rendered, or on the right or privilege of rendering the service, or on any object or event incidental to the rendition of the service, as the result of any new or amended laws after August 31,1981. CHARACTER OF SERVICE: A-C; 60 hertz; single or three phase. MINIMUM CHARGE: $8.00 per month for each connected meter. EFFECTIVE DATE: October 10,1984
