HomeMy WebLinkAboutResolution - 082263P - Order For City Bond Election - 08_22_1963 g-z MINUTES PERTAINING TO RESOLUTION AND ORDER FOR CITY BOND ELECTION THE STATE OF TEXAS CITY OF LUBBOCK COUNTY OF LUBBOCK ON THIS, the 22nd day of August, 1963, the City Com- mission of the City of Lubbock, Texas, convened in regular session at the regular meeting place thereof in the City Hall, there being present and in attendance the following members, to-wit: JACK F. STRONG MAYOR W. E. ALDERSON ROLAN SIMPSON W. C. O'MARA COMMISSIONERS MARVIN McLARTY, JR. and MRS. LAVENIA LOWE CITY SECRETARY also being present; and with the following absent: None , constituting a quorum; at which time the following, among other business, was transacted, to-wit: Commissioner McLarty introduced the following resolution and order: "A RESOLUTION AND ORDER by the City Commission of the City of Lubbock ordering an election to be held in I said City on the 17th day of September, 1963, for I the purpose of submitting to the qualified electors of the City of Lubbock, who own taxable property therein and who have duly rendered the same for tax- ation, six several propositions for ;t.he issuance of eneral obligation tax-supported bonds aggregating 168,000 in principal amount for the acquisition and construction of permanent public improvements relating to the City's Waterworks, Sanitary Sewers, Streets, Drainage and Storm Sewers, Airport and Parks, and one proposition for the issuanceof special obli- gation revenue-supported bonds in the principal amount of $7,500,000 for constructing improvements and extensions to the City's Electric Light System; desig- nating the places at which said election shall be held; appointing the officers therefor; prescribing the form of ballot; providing for notice; enacting provisions incident and relating to the subject of this resolu- tion; and declaring an emergency." l The resolution and order was read in full. Thereupon Commissioner McLarty moved that the Charter rule pro- hibiting the passage of resolutions on the day on which introduced, unless declared an emergency measure, be suspended for the reasons set forth and defined in the preamble thereto. The motion was seconded by Commissioner O'Mara and carried by the following vote: YEAS: Mayor Strong and Commissioners Alderson, Simpson, O'Mara and McLarty. NAYS: None. Commissioner O'Mara then moved that the resolution and order be finally passed as an emergency measure to take effect immediately from and after its passage. The motion was seconded by Commissioner McLarty and carried by the following vote: YEAS: Mayor Strong and Commissioners Alderson, Simpson, O'Mara and McLarty. NAYS: None. The Mayor then announced final passage and immediate effect of the resolution and order as an emergency measure. WHEREAS, the City Commission of the City of Lubbock, Texas, deems it advisable and in the City's best interest that bonds of the City be authorized and issued for the purposes hereinafter stated; and WHEREAS, the City Commission has FOUND and hereby DECLARES there is an urgent public necessity for acquisition of the improve- ments to be provided and constructed with the proceeds of said bonds at the earliest possible date and that therefore this resolution for the authorization of said bonds constitutes an emergency measure for the immediate preservation of the public peace, property, health, safety, good government, order and security of the City and its inhabitants; therefore BE IT RESOLVED AND ORDERED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1: That an election be held on the 1 th day of September, 19-63 which date is not less than fifteen (15) nor more than thirty (305 days from the date of the adoption of this resolu- tion and order, at which election there shall be submitted to the qualified electors of said City, who own taxable property therein and who have duly rendered the same for taxation, the following propositions: PROPOSITION NUMBER 1 "SHALL the City Commission of the City of Lubbock, Texas, be authorized to issue TWO MILLION FIVE HUNDRED THOUSAND DOLLARS ($2,500,000) general obligation bonds of said City for the purpose of making permanent public improvements, to-wit: constructing improvements and extensions to the City's Waterworks System; said bonds to mature serially over a period of years not to exceed forty (40) years from their date, and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, pay- able annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NUMBER 2 "SHALL the City Commission of the City of Lubbock, Texas, be authorized to issue NINE HUNDRED SEVENTY THOUSAND DOLLARS ($970,000) general obligation bonds of said City for the purpose of making permanent public improvements, to-wit: constructing improvements and extensions to the City's Sani- tary Sewer System, including the acquisition of necessary rights-of-way; said bonds to mature serially over a period of years not to exceed forty (40) years from their date, and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NUMBER 3 "SHALL the City Commission of the City of Lubbock, Texas, be authorized to issue ONE MILLION TWO HUNDRED THOU- SAND DOLLARS ($1,200,000) general obligation bonds of said City for the purpose of making permanent public improvements, to-wit: constructing street improvements for said City, including acquisition of rights-of-way; said bonds to mature serially over a period of years not to exceed forty (40) years from their date, and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinkinf fund suffi- cient to redeem said bonds as they become due? ' PROPOSITION NUMBER 4 "SHALL the City Commission of the City of Lubbock, Texas, be authorized to issue ONE MILLION SEVEN HUNDRED FIFTY THOUSAND DOLLARS ($1,750,000) general obligation bonds of said City for the purpose of making permanent public improvements, to-wit: constructing, enlarging, extending and installing storm sewers, drains, and gutters, and other improvements incidental thereto in and for said City, includ- ing the acquisition of land for drainage purposes; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund suffi- cient to redeem said bonds as they become due?" PROPOSITION NUMBER 5 "SHALL the City Commission of the City of Lubbock, Texas, be authorized to issue NINE HUNDRED NINETY-EIGHT THOUSAND DOLLARS ($998,000) general obligation bonds of said City for the purpose of making permanent public improvements, to-wit: acquiring and constructing improvements for the Cityrs airport and airport facilities; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinkin§ fund suffi- cient to redeem said bonds as they become due? PROPOSITION NUMBER 6 "SHALL the City Commission of the City of Lubbock, Texas, be authorized to issue SEVEN HUNDRED FIFTY THOUSAND DOLLARS ($750,000) general obligation bonds of said City for the purpose of making permanent public improvements, to-wit: purchasing and/or improving lands for public parks in and for said City; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually; and to provide for the payment of principal of and interest on said bonds by levying a tax sufficient to pay the annual interest and to create a sinking fund sufficient to redeem said bonds as they become due?" PROPOSITION NUMBER 7 "SHALL the City Commission of the City of Lubbock, Texas, be authorized to issue SEVEN MILLION FIVE HUNDRED THOUSAND DOLLARS ($7,500,000) revenue bonds of said City for the purpose of constructing improvements and extensions to the City's Electric Light System and including the purchase of necessary sites therefor; said bonds to mature serially over a period of years not to exceed forty (40) years from their date and to bear interest at a rate not to exceed FIVE PER CENTUM (5%) per annum, payable annually or semi-annually, said revenue bonds to be special obligations payable as to both principal and interest solely from and secured by a first lien on and pledge of the revenues of the City'.s Elec- tric Light System, after deduction of reasonable operation and maintenance expenses as such expenses are defined by statute?" Gerdeman, Clerk SECTION 3: That said election shall be held under the provisions of and in accordance with the laws governing the issuance of municipal bonds in cities, as provided in the General Laws of the State of Texas, and only qualified electors, who own taxable pro- perty in the City, and who have duly rendered the same for taxation, shall be qualified to vote. SECTION 4: That the ballots for said election shall be prepared in sufficient number and in conformity with Chapter 6, V.A.T.C.S. Election Code, as amended, and that printed on such bal- lots shall appear the following: PROPOSITION NUMBER 1 FOR THE ISSUANCE OF $2,500,000 WATERWORKS SYSTEM BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF $2,500,000 WATERWORKS SYSTEM BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF PROPOSITION NUMBER 2 FOR THE ISSUANCE OF $970,000 SANITARY SEWER SYSTEM BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF $970,000 SANITARY SEWER SYSTEM BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF PROPOSITION NUMBER 3 FOR THE ISSUANCE OF $1,200,000 STREET IMPROVEMENT BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF $1,200,000 STREET IMPROVEMENT BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF PROPOSITION NUMBER 4 FOR THE ISSUANCE OF $1,750,000 STORM SEWER AND DRAINAGE BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF $1,750,000 STORM SEWER AND DRAINAGE BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF PROPOSITION NUMBER 5 FOR THE ISSUANCE OF $998,000 AIRPORT BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF $998,000 AIRPORT BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF PROPOSITION NUMBER 6 FOR THE ISSUANCE OF $750,000 PARK BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF AGAINST THE ISSUANCE OF $750,000 PARK BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF PROPOSITION NUMBER 7 FOR THE ISSUANCE OF $7,500,000 REVENUE BONDS FOR ELECTRIC LIGHT SYSTEM IMPROVEMENTS AND EXTENSIONS AND PLEDGING THE REVENUES OF SAID SYSTEM TO THE PAYMENT THEREOF AGAINST THE ISSUANCE OF $7,500,000 REVENUE BONDS FOR ELECTRIC LIGHT SYSTEM IMPROVEMENTS AND EXTENSIONS AND PLEDGING THE REVENUES OF SAID SYSTEM TO THE PAYMENT THEREOF AS TO EACH of the foregoing propositions, each voter shall mark out with pen or pencil one of the above expressions, thus leaving the other as indicating his or her vote on the seven pro- positions respectively. SECTION 5: That a copy of this resolution and order, signed by the Mayor of the City and attested by the City Secretary, shall serve as proper notice of said election. SECTION 6: That notice of said election shall be given by posting and publication of a copy of this resolution and order, at the top of which shall appear the words "NOTICE OF CITY BOND ELECTION". Said notice shall be posted at the City Hall and at each of the polling places in said City, not less than fourteen (14) full days prior to the date on which said election is to be held, and be published on the same day in each of two successive weeks in the LUBBOCK AVALANCHE-JOURNAL, which is a newspaper of general circula- tion published in the City of Lubbock, Texas, the first of said publications to be made not less than fourteen (14) days prior to the date set for said election. SECTION 7: The public importance of this measure and the fact that it is to the best interest of the City of Lubbock to construct the improvements indicated by the propositions for the issuance of bonds hereinabove set out, at the earliest possible date, for the immediate preservation of the public peace, property, health and safety of the citizens of said City, constitute and create an emergency and an urgent public necessity requiring that this resolution and order be passed and take effect as an emergency measure, and that this resolution and order is accordingly passed as an emergency measure and shall take effect and be in force immed- iately from and after its passage, and it is so resolved and ordered.
