BELOW: RESOLUTION ACCEPTING IMPROVEMENTS ON A PORTION OF f\ STREET AS LISTED

WHEREAS, in conformance with the paving requirement provisions of
h}j City Ordinance 1331, the subdivider of Mackenzie Terrace Addition, made
arrangements with Kerr Construction Co. for the construction of paving
improvements on certain street dedicated in said subdivision under the
provisions of said Ordinance prior to the recording of the subdivision plat
of Mackenzie Terrace including the following street:
East one-half of Quirt Avenue (curb and gutter only) from the south paving
line of East 4th Street to its intersection with a line 3 feet South of the
South Property Line of the alley South of East 4th Street
AND WHEREAS, the construction of the above improvements on the above-
mentioned street was performed under the supervision of the City Engineer,
and said improvements have been completed and have been inspected and found
to have been constructed in accordance with city specifications and in
accordance with the provisions of City Ordinance 1331.
THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS.
I.
"+ That the improvements on said portions of the abovementioned street
be and the same are hereby accepted and the City Engineer be and he is hereby
authorized to direct the payment of the city's portion of the cost and to
release escrow money.
II.
This resolution shall take effect and be in force from and after its
passage.

Gentlemen:
I have examined the paving improvements constructed by Kerr
Construction Co., paving contractor, under their contract with the
subdividers of Mackenzie Terrace Addition and find the improvements on
East 1/2 of Quirt Avenue (curb and gutter only) as listed on the final
estimate sheet to have been completed in accordance with the plans and
specifications and recommend that you accept the improvements on said
streets and/or avenues, authorizing payment to the contractor the amount
shown on the attached consolidated final estimate sheet as due them by
the City of Lubbock.
