HomeMy WebLinkAboutResolution - 1594 - Establish Rules And Set Hearings For Mineral Rights In Public Parks - 03_08_1984JCR:cl RESOLUTION 1594 - 3/8/84 RESOLUTION WHEREAS, Lubbock voters will decide on Saturday, April 7th, whether to allow the City Council to exercise the mineral rights on certain public properties designated for park uses, and WHEREAS, revenues gained from oil or gas royalties would be dedicated to park acquisition and improvements, as required by state law, and WHEREAS, the City Council of the City of Lubbock wishes to assure citizens that every possible safeguard to the environment will be utilized in the event that oil or gas wells are permitted on property designated for park uses, NOW THEREFORE BE IT RESOLVED that the following policies will be observed when exercising our mineral rights or allowing for drilling on property designated for park uses: 1. A lease of public mineral rights will be awarded only to the highest bidder following a public hearing in which citizens will be able to voice opinions and seek information on the proposed lease; 2. Drilling permits will be authorized by the City Council only . after a public hearing in which surrounding property owners will be able to comment on the proposed drilling operation; 3. In addition to required public notices, full and complete publicity will be sought in an effort to alert interested citizens to the date, time and place of all public hearings; 4. Registered letters announcing the public hearing will be sent to owners of all property located within 300 feet of the boundary of property being considered for leasing or drilling operations; 5. The City Council will exercise its full authority, as granted by ordinance, to regulate the following: a. The location of an oil or gas well. b. Requirements for devices to control noise, odor and air pollution. c. Restricted access to a well site. d. The type and height of pump equipment. e. Safety precautions. 'f. Time of day of drilling operations. g. Fencing and screening. h. Landscaping. i. Location of storage facilities. In this regard, it will be the policy of the City Council to prohibit oil storage tanks on property utilized as park areas. j. Protection of the water aquifer. k. Protection of areas and items of historic significance. BE IT FURTHER RESOLVED THAT the City Council of the City of Lubbock encourages voters to support this proposition on the ballot on April 7th in order that the public can benefit from the value of minerals beneath public property. Passed by the City Council this 8th day of March 9 1984.
