HomeMy WebLinkAboutResolution - 1591 - Contract - Hicks & Ragland Inc - Telecommunications, Municipal Complex - 02_23_1984DGV:js RFSnI I IT TnAI RESOLUTION 1591 - 2/23/84 WHEREAS, the telecommunications industry has recently been deregulated to provide an increased level of competition in the telecommunications services and equipment; and WHEREAS, it is in the best interest of the citizens of the City of Lubbock that the city government have the most efficient telecommunications system possible; and WHEREAS, the City of Lubbock has sought proposals from experts in the telecommunications field to provide professional services with regard to needs analysis, system planning, bid specifications and evaluation of bid proposals; and WHEREAS, the City of Lubbock has opened said proposals for profes- sional telecommunications services and has determined the best proposal; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a special services contract --telephone with Hicks & Ragland Engineering Co., Inc., which contract is attached herewith and which contract shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein. Vandiver, Assistant -City Attorney RESOLUTION 1591 - 2/23/84 SPECIAL SERVICES CONTRACT CITY OF LUBBOCK MUNICIPAL COMPLEX SPECIAL SERVICE CONTRACT SPECIAL SERVICES -TELEPHONE AGREEMENT made as of Feb. 23 , 19 84 between CITY OF LUBBOCK (hereinafter called the 'Owner") and HICKS & RAGLAND ENGINEERING CO., INC.(hereinafter called the "Engineer") . NOW, THEREFORE, in consideration of the mutual understanding herein contained, the parties hereto agree as follows: ARTICLE I" General The Engineer shall render diligently and competently the engineering services described in Article II, upon the terms and conditions herein stated. ARTICLE II Services The Engineer will perform the following services in an expeditious manner: SEE ATTACHED SHEET Charges for this work will be billed under EJO #44-855-01 It is agreed, without limiting the generality of the foregoing, that all drawings, designs, specifications and other incidental engineering -work or materials, furnished by the Engineer hereunder shall be and remain the property of the Owner. All services to be rendered hereunder shall be subject to the direction and approval of the Owner. - 1 - H&RCF100 5-83 0. ARTICLE III Compensation The Owner shall pay the Engineer for services performed hereunder a sum equal to time rates of the Engineer, plus expenses, which sum shall be due and payable ten (10),.days after approval by the Owner of the services performed hereunder and the invoice of the Engineer therefore, including the detailed breakdown of the cost by services performed. The Engineer shall submit itemized monthly invoices to the Owner. A schedule of time and expense rates is attached. Interest. Interest at the rate of TWELVE percent ( 12% > per annum shall be paid by the Owner to the Engineer on any unpaid balance due the Engineer, commencing thirty (30) days after the due date, provided that the delay in payment beyond the due date shall not have been caused by any conditions within the control of the Engineer. ARTICLE IV Miscellaneous Section 1. License: The Engineer shall comply with all applicable statutes pertaining to engineering and warrantes that he possesses License Number 41663 issued to him by the State of TEXAS on JUNE 30 , 19 77 . Section 2, Insurance: The Engineer shall take out and maintain work- men's compensation insurance, public liability insurance, and auto- mobile liability insurance as prescribed by the latest revisions of REA Bulletin 340-5. Compliance with future revisions of Bulletin 340-5 will be made within 90 days after date of issuance of the revision. Section 3. Qualified Personnel: The obligations and duties to be per- formed by the Engineer under this Agreement shall be performed by per- sons qualified to perform such duties efficiently. The Engineer, if the Owner shall so direct, shall replace any engineer or other person employed by the Engineer in connection with the work. Section 4. Terms of Agreement: This Agreement shall become effective as of the date hereof and shall remain in effect until terminated by either party giving thirty days notice to the other party of its intention to terminate. MW40 H&RCF100 5-83 Section 5. Assignment: The obligations of the Engineer under the Agreement shall not be assigned without the approval of the Owner. Expenses. These will include reasonable transportation cost of employees, plus the cost of prints, mailing and transportation ex- penses relating to printed and other materials and equipment, and telephone and telegraph expenses. PLAN OF WORK FOR THE CITY OF LUBBOCK MUNICIPAL COMPLEX The following tasks are to be performed: 1. Complete an analysis of the telecommunication needs for the City of Lubbock's Municipal Complex. Maximum cost for task is $3,135. 2. Develop a plan for a telecommunications system for the Municipal Complex. Maximum cost for this task is $4,985. 3. Prepare a set of specifications for a telecommunications system to include options tied to various levels of services for the new Municipal Complex. Maximum cost for this task is $4,990. 4. Assist in the evaluation and selection of the vendors, including a cost analysis of options. Maximum cost for this task is $3,820.
