Jt WHEREAS, the City Commission of the City of Lubbock has heretofore
1 4- k determined and now finds that due to increased vehicular traffic on
? East 50th Street in the City of Lubbock, it is necessary to open, extend,
straighten and widen said East 50th Stream ; and,
WHEREAS, to accomplish this purpose, it is necessary to acquire for
street right of way purposes the fee simple title of the land hereafter
' described; and,
# WHEREAS, Southside Church of Christ of Lubbock County, Texas
and Mrs. J. B. Durham
1 own said land, and the value and total damages to the owner for the fee simple
title to said land have been appraised in the amount of $ 2245.00 ` and the
Commission finds said amount to be fair and equitable; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated
( in the City of Lubbock, Lubbock County, Texas, be acquired by the City of
Lubbock for the purpose of opening, extending, straightening and widening
the public street known and designated as East 50th Street
which land is more particularly described as follows:
A parcel of land out of Section 4, Block B, Lubbock County, Texas,
more fully described by metes and bounds as follows:
BEGINNING at a point 1152.0 feet East and 28.25 feet North of
( the SW corner of said section; (said point of beginning is the
original SW corner of Lot 14, Block 8, in the Clutter Addition
to the City of Lubbock, as said original corner exists on the
ground)
i. THENCE North a distance of 16.75 feet to a point;
THENCE Northeasterly a distance of 396.02 feet to a point said
(� point being in the East line of Lot 15, Block 8, in said Clutter
Addition and being 30.0 feet North of the South line of said
section 4, Block B;
THENCE South a distance of 20.21 feet to a point;
s THENCE Westerly a distance of 396.0 feet to the point of beginning.
THAT the owner(s) of said land be offered, through the Right of Way Depart-
ment, the amount appraised as the value and total damages for the fee simple
1 title and acquisition of said land for the purposes herein stated, for the use C
and benefit of the City of Lubbock, and unless accepted forthwith the City
Attorney is hereby authorized and instructed to institute condemnation pro-
ceedings for and on behalf of the City of 'Lubbock to icquire the fee simple
title to said land as hereinabove described for street purposes.
