f A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND DELIVER
TO PIONEER NATURAL GAS COMPANY, A CORPORATION, A GAS PIPE LINE
EASEMENT ON BEHALF OF THE CITY OF LUBBOCK TO CERTAIN PROPERTY
SITUATED IN LUBBOCK COUNTY, TEXAS, SAID PROPERTY BEING MORE
PARTICULARLY DESCRIBED IN THE BODY OF THIS RESOLUTION.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Mayor BE and he is hereby authorized and directed
to execute on behalf of the City of Lubbock a Gas Pipe Line Easement to Pioneer
Natural Gas Company on the following described property:

4 A parcel of land out of Section 17, Block B, Lubbock County, Texas,
more fully described as follows:

BEGINNING at the point _of intersection of the North line of 34th
Street by-pass and the North right of way line of the Panhandle and
�i Santa Fe Railway, said point being 1,126.4 feet North 530 561 East
of a point in the West section line of said Section 17, Block B, the 1
point in the West line of said section being 441 feet North of the
Southwest corner of said Section 17, Block B;

THENCE North 530 56t East a distance of 100 feet to a point;
ii THENCE North 360 041 West a distance of 10 feet to a point;
THENCE South 530 56t West a distance of 100 feet to a point;
THENCE South 360 04t East a distance of 10 feet to the POINT OF

SECTION 2. The City Secretary-Treasurer is hereby authorized to attest
such Gas Pipe Line Easement affixing the seal of the City of Lubbock thereto.

GAS PIPE LINE EASEMENT
THE STATE OF TEXAS {
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK I
THAT, the City of Lubbock a Home Rule Municipal Corporation of
Lubbock,County, Texas, acting herein by and through its officers heretofore
duly authorized, for and in consideration of the sum of ONE AND N0/100
($1.00) DOLLAR, cash to it in hand paid by the Pioneer Natural Gas Company,
a Corporation of Lubbock County, Texas, receipt of which is hereby acknowledged
and confessed, have Granted, Bargained, Sold and Conveyed, and by these
presents do Grant, Bargain, Sell and Convey unto the said Pioneer Natural
Gas Company a free- and uninterrupted use, liberty and privilege in, along,
upon, under, through, and across that certain tract of land located and situated
in Lubbock County, Texas, more particularly described as follows:
A parcel of land out of Section 17, Block B, Lubbock County, Texas,
more fully described as follows.
BEGINNING at the point of interesection of the North line of 34th
Street by-pass and the North right of way line of the Panhandle and
Santa Fe Railway, said point being 1, 126. 4 feet North 530 56' East
of a point in the West section line of said Section 17, Block B, the
point in the West line of said section being 441 feet North of the
South-west corner of said Section 17, Block B;
THENCE North 530 56' East a distance of 100 feet to a point;
THENCE North 360 04' West a distance of 10 feet to a point;
THENCE South 530 56' West a distance of 100 feet to a point;
THENCE South 360 04' East a distance of 10 feet to the POINT
OF BEGINNING;
for the purpose of constructing, operating and maintaining a natural gas pipe
line and booster station and for the purpose of setting and maintaining all
necessary appurtenances required for the construction, operation and
maintenance of such natural gas pipe line and booster station; provided,
however, that the Grantee herein shall place and construct said line within
and along the Easement herein granted in an approved manner and hereby
agrees and obligates itself to compact the backfill in such manner so as to
prevent settlement and to otherwise keep and maintain such pipe line with
as little damage to the premises as may be practicable considering the nature
of the construction and use to which said premises are to be put and further
granting the Pioneer Natural Gas Company the right to enter upon said described
land for the purpose of maintaining or repairing said natural gas pipe line
and booster station at any time and season and providing further that Grantee
herein shall repair any damage occasioned by any necessary maintenance or
repair work.
TO HAVE AND TO HOLD all and singular the premises aforesaid unto
the said Pioneer Natural Gas Company, its successors and assigns,

BEFORE ME, the undersigned authority, a Notary Public in and for
said County, Texas, on this day personally appeared JACK F. STRONG, known
to me to be the person whose name is subscribed to the foregoing instrument
and acknowledged to me that he executed the same as the act and deed of the
CITY OF LUBBOCK and as MAYOR, for the purposes and consideration therein
expressed, and in the capacity therein stated.
