HomeMy WebLinkAboutResolution - 112062F - Joint Paving Release - Kerr Paving Co. - GWO 2660 - 11_20_1962 Zg RESOLUTION ,IZF B E I T RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock, is hereby authorized and directed �! to execute for and on behalf of said City a Joint Paving Release with Kerr Paving Company, Contractor, covering certain Sub-units of Units Nos. 2046, 2048 and C ( 2051, Ordinance No. 3470, of the City of Lubbock, Texas, and certain Sub-units �• ', of Units Nos. 2045, 2046, 2048 and 2049 deleted from Ordinance No. 3470, but included in the "Notice of Intent" recorded in Volume 341, Page 167, of the Deed Records of Lubbock County, Texas; said sub-units are as follows: 2046-1,• 2046-19, 2046-25, 2046-32, 2046-33, 2046-45, 2046-46, 2046-49, 2046-50, 2046-54, 2046-55, 2046-57, 2048-19, 2048-20,2048-21, Part of 2051-2, 2051-3, „,� I`, these units are included in Ordinance No. 3470; 2045-1, 2046-2, 2046-4, Part of 2046-8, 2046-18, 2046-53, 2046-56, 2048-11, 2048-12, 2048-18, 2048,-23, 2048-24, 2048-25, 2049-3, 2049-4,-2049-5, 2049-6, 2049-7, 2049-8, these i I units are included in the !'Notice of Intent". i A copy of said Release is attached hereto and made a part of this Ii Resolution. fPassed by the City Commission this 20th day of November , 1962. Lav6plia Lowe, Cit3e Secret ry-Treasurer I it I� it �i i : i E JOINT PAVING RELEASE THE STATE OF TEXAS } COUNTY OF LUBBOCK } WHEREAS, heretofore on May 25, 1961, the City of Lubbock passed Ordinance No. $470, such instrument being recorded in Volume 843, Page 166 of the Deed Records of Lubbock County, Texas, such Ordinance con- taining a notice of improvements and appointment of costs of such Improve- ments, by assessing liens upon properties abutting,thereon, and in such Ordinance there was included paving assessments for certain Paving Sub-units of Paving Units Nos. 2046, 2048 and 2051: and, WHEREAS, under these Paving Sub-units, such improvements, have created no liens against the properties assessed pursuant to said Sub-units by reason of the fact that such paving improvements have not been made and there is no immediate plan of making street improvements upon the streets abutting said flub-units, and it is expedient to remove the cloud and apparent liens placed upon the title of properties abuttinj the street as aforementioned; and. WHEREAS, heretofore on April 27, 1961, the City of Lubbock deleted from Ordinance No. 3470 certain Paving Sub-units of Paving Units Nos. 2045, 2046. 2048 and 2049 and therefore no lien was perfected against the properties abutting these sub-units but title was clouded by these sub-units being in the "Notice of Intent" that was recorded in Volume 341, Page 167, of the Deed Records of Lubbock County, Texas and it is expedient to remove the cloud placed upon the title of these propertiesi NOW THEREFORE: KNOW ALL MIEN BY THESE PRESENTS: THAT. in consideration of the premises of the CITY OF LUBBOCK, acting by and through its officers heretofore duly authorized, and the KERR PAVING COMPANY, Contractor, do hereby RELEASE, RELINQUISH, and FOREVER QUIT CLAIM and by these presents have RELEASED, RELINQUISHED and FOREVER QUIT CLAIMED to the owners of the properties affected by the paving assessment liens and "Notice of Intent" herein ai ove mentioned, their heirs, administrators, executors and assigns, all right, title and interest they may have in and to all those lots, tracts or parcels of land abutting the following described sub-units: 2046-1 East 6th Street from 7' tast of the W.P.L. of Beech Avenue to 201 E. of the E.P.L. of Lot 1, Manor Addition. 2046-19 North Canton Avenue from the S.P.L. of Dartmouth Street to 11, Property Line of Cornell Street. 2046-25 43rd Street from 14' E. of the E.P.L. of Avenue H to Sr E. of the E.P.L. of Avenue D. 2046-32 Toledo Avenue from the S.P.L. of 36th St. to 2' N. of the North Property Line of 37th Street.
