RESOLUTION
RESOLUTION 101 - 6/9/83
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Social Security
Overpay Program Contract between Management Resource Controls and City of
Lubbock, attached herewith which shall be spread upon the minutes of the
Council and as spread upon the minutes of this Council shall constitute and be
a part of this Resolution as if fully copied herein in detail.
Passed by the City Council this 9th day of June ,1983.

Re: Letter Agreement
Dear Sirs:

The City of Lubbock, hereinafter referred to as "employer", hereby re-
tains Management Resource Controls to provide services necessary to recover
monies due the employer as the result of overreporting of taxable wages for
the tax years ending December 31, 1979, 1980 and 1981.
Management Resource Controls will examine records, compile the data
required as documentation, file amended tax returns and act on the employer's
behalf to ensure prompt recovery on behalf of both employer and the employer's
employees.
The employer agrees that Management Resource Controls will receive fifty
percent (50%) of the employer's portion of all refunds and/or credits received
as a result of its efforts. This payment does not include any portion of
refunds and/or credits secured by Management Resource Controls on behalf of
the employer's employees, but Management Resource Controls will nevertheless
attempt to secure refunds for employees.
Management Resource Controls will assist the employer in implementing
procedures necessary to disburse the employee's portion of any refunds and/or
credits received.
There will be no retainer advanced to Management Resource Controls by the
employer and if there is no recovery, there will be no payment whatsoever due
Management Resource Controls from the employer.

The above and foregoing constitutes the full agreement between the parties,
hereto and such agreement may not be changed except by written amendment or
addendum hereto executed by both parties.

SOCIAL SECURITY OVERPAY PROGRAM
.CONTRACT
The City of Lubbock, hereafter referred to as the employer, retains Management
Resource Controls to provide services necessary to recover monies due the employer
as the result of overreporting of taxable wages for the taxable years ended
December 31, 1979, 1980, and 1991.
Management Resource Controls will examine records, compile the data required as
documentation, file amended tax returns and act to ensure prompt recovery.
The employer agrees that Management Resource Controls will receive fifty percent
(50%) of the employer's portion of all refunds and/or credits received as a result of
its efforts. A nominal retainer will be provided by the employer when Management
Resource Controls' services begin. The amount of the retainer will be subtracted
from Management Resource Controls' charges. The balance will be due Management
Resource Controls upon receipt of said refunds and/or credits applied. (Amount of
the retainer $ -0- .)
Management Resource Controls will assist the employer in implementing procedures
necessary to disburse the employee's portion of refunds and/or credits, as received. .
The foregoing constitutes the full agreement between us and may not be changed
orally but only by written consent of both parties.
