HomeMy WebLinkAboutResolution - 092762E - Agreement - ATSF Railway Company - Use Of Borrow Area - 09_27_1962 B JMc'1km R M RESOLUTION aZ �Z Io ryj. r /i �' ! �o ` f A RESOLUTION AUTHORIZING THE CITY OF LUBBOCK TO ENTER AN ' AGREEMENT WITH THE AT'OHISON, TOPEKA AND SANTA FE RAILWAY COM - PANY,' WESTERN LINES, FOR THE CITY OF LUBBOCK TO USE A BORROW AREA BELONGING TO THE ATCHINSON, TOPEKA AND SANTA FE RAILWAY 9 COMPANY FOR THE PURPOSES OF TAKING EARTH FROM SAID AREA TO ° CONSTRUCT AN OVERPASS AT 26TH STREET AND WEBER AVENUE. WHEREAS, it has been_determined by the City Commission of the City of Lubbock that an overpass is to'be constructed on 26th Street and Weber Avenue; and WHEREAS, the Atchison, Topeka and Santa Fe Railway Company, Western Lines, owns property adjacent to the site of the proposed 26th Street overpass fro I which earth can be taken for the construction of said overpass; and, WHEREAS the Atchison Topeka and Santa Fe Railroad Company, Western I ,� : P P Y� Lines, has offered an agreement, through its Chief Engineer, Mr, J. E. Eisemann of AmariHo,R Texas, for the City of Lubbock to use the borrow area adjacent to the proposed overpass to obtain therefrom the earth necessary to construct such overpass, at no charge to the City of Lubbock; NOW THEREFORE,' BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: L{ SECTION lid THAT the Mayor of the City of Lubbock is hereby authorized ito sign and enter into agreement with the Atchison, Topeka and Santa Fe Railway '+ Company, Western Lines, under the terms of the letter-agreement from Mr. J.E. 1l Eisemann, Chief Engineer for the Amarillo, Texas division of the Atchison, It Topeka and Santa Fe Railway Company, Western Lines, and addressed to Mr. l! JohnSadtf4 Right of Way Engineer for the City of Lubbock; said letter being dated September 17, 1962. h SECTION 2. THAT the City Secretary -Treasurer is hereby authorized and it .s directed to attest the signature of the Mayor to the said agreement, affixing the se ;I of the City of Lubbock thereto.
