JORDAN and her husband, DON JORDAN, which occurred within the City of Lubbock on {j February 8, 1962; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor be and is hereby authorized and directed on behalf of the 4� Cityof Lubbock to execute and to deliver unto the said LEOTA M. JORDAN. and t i DON JORDAN, her husband, a release for and in consideration of EIGHT HUNDRED, it DOLLARS AND N0/100 ($800.00). iI i �I THAT the City Secretary=Treasurer is hereby authorized and directed �i to attest the signature of the Mayor to the said Release. JORDAN and DON JORDAN in the amount of EIGHT HUNDRED DOLLARS AND NO/100($800.00) said claim being made for a collision between a City of Lubbock fire truck and an automobile operated by LEOTA M. JORDAN arising out of the following occurrence: the said LEOTA:M. JORDAN, while proceeding South on Avenue G in the City of Lubbock, Lubbock County, Texas collided with a fire truck proceeding East on 14th Street in the City of Lubbock, Lubbock County, Texas, while such fire truck,was engaged in an emergency call, and, WHEREAS, in order to settle such dispute and difference the parties have agreed on a full and final settlement and compromise of the above- described claim and of all causes of action, damages, liabilities, expenses, and costa arising by reason of the occurrence and transactions above- mentioned whether heretofore or hereafter accruing and whether now known or not known to the parties hereto, NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: For and in consideration of the sum of EIGHT HUNDRED DOLLARS AND NO/100($800.00) to it in hand paid by LEOTA M. JORDAN and DON JORDAN the receipt of which is hereby acknowledged and confessed, the City of Lubbock, acting by and through its Mayor does hereby and by these presents release the said LEOTA M. JORDAN and DON JORDAN.of and from all causes of action, damages, liabilities, expenses, and costs whatsoever arising by reason of said occurrences and transactions whether heretofore or hereafter accruing and whether now known or not known to the parties hereto. The undersigned understands and agrees that the payment of the said sum is not to be construed as an admission of any liability whatsoever on the part of the party released, and that this release is fully understood and voluntarily made and accepted for the purpose of making a full and final compromise and settlement of such claim.
