Wilson - Section 3 Block E2 - 08_09_1962 { RESOLUTION f J WHEREAS, the City Commission has determined that certain errors in the d scription to land have occurred in the Quitclaim Deed from the CITY OF LUBBOCK to FRANK D. WILSON; and, " j" WHEREAS, the City Commission has decided, to preclude difficulties hereafter, to rectify said errors by a Correction of Quitclaim Deed from the CITY OF LUBBOCK to FRANK D. WILSON; NOW THEREFORE: BEJT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor be and is hereby authorized and directed on behalf of the CITY OF LUBBOCK to execute and to deliver unto the said FRANK D. WILSON for and in consideration of sum of ONE AND NO/100 ($1.00) DOLLARS a jj Correction of Quitclaim Deed. Ifs THAT the City Secretary-Treasurer is hereby authorized and directed to attest the signature of the Mayor to said Correction of Quitclaim Deed affixing the seal of the City of Lubbock thereunto. Strong, in the County of Lubbock, State of Texas, party of the first part, and FRANK D WILSON, of Lubbock, in the County of Lubbock, State of Texas, party of the second part, witnesseth: WHEREAS, the party of the first part, did, on or about the 29th day of September, 1953, execute to the party of the second part for the consideration therein mentioned, a quitclaim conveyance of certain lands, situated in Lubbock County, Texas, and hereinafter more particularly described,which said conveyance is recorded in Volume 517, page 67 of the Deed Records of Lubbock County, Texas; and whereas, in said quitclaim conveyance, by mistake, the following errors were committed, to wit: In Tract One of the description by metes and bounds appear the words ". .. 2590.0 feet East of the Southwest Corner?whereas they should appear 2 580.0 feet east of the Southwest Corner. . Furthermore, in Tract One the words appear "THENCE in a south- easterly direction along a curve to the right ."' whereas they should appear THENCE in a southeasterly direction along a curve to the left. . . Furthermore, in Tract One the words appear"THENCE in a south- westerly direction along a curve to the left. . ." whereas they should appear THENCE in a southwesterly direction along a curve to the right. . . In Tract Two the words appear "BEGINNING at a point which is 2560.0 feet North and 2590.0 feet East" whereas they should appear Beginning at a point which is 2560.0 feet north and 2 560.0 feet east. . . Furthermore, in Tract Two the words appear"THENCE in a South- easterly direction along a curve to the right" whereas they should appear Thence in a southeasterly direction along a curve to the left. And whereas, to prevent difficulties hereafter, it is expedient to correct said errors. Now, therefore, this conveyance witnesseth, that the party of the first part, in consideration of the premises and of;done dollar to it remitted by the party of the second part, hereby BARGAINS, SELLS, RELEASES, and QUITCLAIMS unto party of the second part, his heirs and assigns, forever all of the following tracts of land situated in the County of Lubbock, in the State of Texas, to wit: TRACT ONE: That portion of the Southwest One-fourth Section of Section Three IS), Block E-2, Lubbock County, Texas, which is in the present City limits of Lubbock, Texas, the tract of land being described as: BEGINNING at a point which is 2415.0 feet North and 2580.0 feet East of the Southwest Corner of Section 3, Block E-2; i THENCE North a distance of I30.0 feet to a point; j THENCE East a distance of 33. 17 feet to a point; THENCE in a southeasterly direction along a curve to the left an are distance of 24.79 feet to the P.C. of the curve and a point, long chord bearing South 290 15.8' East a dis- tance of 24.79 feet(curve data --R= 317.94 feet; Le 24.79); THENCE on a bearing of South 310 30' East a distance of 25.45 feet to a point; THENCE South a distance of 79.08 feet to a point; j THENCE in a southwesterly direction along a curve to the right an arc distance of 60.04 feet, long chord bearing South 710 47,11 West a distance of 59.80 feet, which is the P.C. of the curve and the point of BEGINNING(curve data -• Rv 185.33; L w 60,04). TRACT TWO: I That portion of the Southwest One-fourth section of Section Three(3), Block E-2, Lubbock County, Texas, which is in the present City limits of Lubbock, Texas, the tract of land being described as: BEGINNING at a point which is 2560.0 feet North and 2580.0 feet East of the Southwest Corner of Section 3, Block E-2; I i THENCE North a distance of 130.0 feet to a point which is the P.T. of a curve and a point on the South Property line of Broadway Street; I THENCE in a Southeasterly direction along a curve to the left an arc distance of 133.38 feet to a point, long chord bearing South 120 01.41 East a distance of 132.28 feet(curve data -- R : 317.94 feet; L = 133.38 feet); THENCE. West a distance of 26.66 feet to the point of BEGINNING. To have and to hold the said premises, together with all and singular the rights, privileges, and appurtenances thereunto in any manner belonging or in anywise appertaining to FRANK D.
