Mcgaw - Mcgaw Addition - 04_26_1962 RL5s 4/25/ 2 _ RESOLUTION 0421#42s 3i WHEREAS, the City Commission of the City of Lubbock by resolution on January 25, 1962 authorized the Right of Way Department to acquire a strip of land on Quirt Avenue owned by E. C. McGaw and wife, Velma Lucille McGaw; and WHEREAS, pursuant to the said resolution E. C. McGaw and wife, Velma Lucille McGaw by Warranty Deed dated March 13, 1962 and recorded in Volume 882 Page 347 of the Deed Records of Lubbock County, Texas, conveyed to the City of Lubbock all that certain land described as a strip of land 30 feet wide, off the West side of Lots 8 and 9, Block 2 of the S. W. McGaw Addition to the City of Lubbock; and, WHEREAS, it was the intention of the said E. C. McGaw and wife, Velma Lucille McGaw to convey and the intention of the City of Lubbock to acquire only that strip of land 30 feet wide off the West side of Lot 8 Block 2 of the S. W. McGaw Addition to the City of Lubbock; and j WHEREAS, it is the desire of both the grantors and grantee in said deed to # correct and clarify the description of the land sought to be conveyed by said deed; NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the City of Lubbock execute a quitclaim to E. C. McGaw and wife, Velma Lucille McGaw of any interest which the City of Lubbock might hold in the following described land located in Lubbock County, Texas, to-wit: A strip of land 30 feet wide, off the West side of Lot 9, Block 2 of the S. W. McGaw Addition to the City of Lubbock. THATIhe Mayor is hereby authorized to execute the instrument- necessary to accomplish the purpose hereinbefore stated. THE STATE OF TEXAS X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK I THAT, WHEREAS, by warranty deed dated March 13, 1962, recorded in Volume 882, Page 347, of the Deed Records of Lubbock County, Texas, E. C. McGaw and wife, Velma Lucille McGaw, conveyed to the City of Lubbock, a Home Rule Municipal Corporation of Lubbock County, Texas, all that certain land des- cribed as a strip of land, 30 feet wide, off the West side of Lots 8 and 9, Block 2 of the S. W. McGaw Addition to the City of Lubbock, Lubbock County, Texas; and WHEREAS, it was the intention of the said E. C. McGaw and Velma Lucille McGaw to convey and the intention of the said City of Lubbock to acquire by said deed only the strip of land, 30 feet wide, off the West side of Lot 8, Block 2 of the S. W. McGaw Addition to the City of Lubbock, Lubbock County,Texas; and WHEREAS, it is the desire of both the grantors and the grantee in said deed to correcttand clarify the description of the land sought to be conveyed by said deed; NOW, THEREFORE, the said City of Lubbock, acting by and through Jack F. Strong, Mayor, for and in consideration of the sum of Ten and N61100 ($10.00) Dollars, the receipt of which is hereby acknowledged, does hereby Bargain, Sell, Release and Forever Quitclaim unto the said E. C. McCaw and Velma Lucille McGaw, their heirs, representatives and assigns, all right, title and interest held by the City of Lubbock in and to the following described land located in Lubbock County, Texas, to-wit: A strip of land, 30 feet wide, off the West side of Lot 9, Block 2 of the S.
