�-' A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE FOR AND ON
BEHALF OF THE CITY OF LUBBOCK A RELEASE OF LIEN HELD BY THE
i CITY OF LUBBOCK AGAINST A PORTION OF SECTION 5, BLOCK A IN
i! LUBBOCK COUNTY, TEXAS.
WHEREAS, heretofore the City of Lubbock duly conveyed a portion of
I� Section 5, Block A in Lubbock County, Texas, containing 156. 700 acres of land
by Warranty Deed dated the loth day of January, 1959; and
WHEREAS, in such deed a vendors lien was retained and a deed of trust
was granted to secure the payment of three (3) certain promissory notes executed]
by the following named corporations:
Willojak Corporation
Harold Blank Corporation
Buddy K Hughes Land Company
C. Jan Jennings Land Company, Inc.
H. C. L. Land Company, Inc.
West Texas Construction Company,, Inc.
payable to the City of Lubbock annually on the loth day of January, 1960, 1961,
1962 as follows:

WHEREAS, such promissory notes have been paid to the City of Lubbock
and fully discharged, both principal and interest, and at the time of payment the
notes,-were owned by the City of Lubbock; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
I SECTION 1. THAT the Mayor be and he is hereby authorized and directe
to execute for and on behalf of the City of Lubbock a release of lien, for and in
consideration of the premises and the full and final payment of said notes have
remised, released, quitclaimed, discharged and acquitted and by1hese presents
do remise, release, quitclaim, discharge and acquit unto the said Willojak Cor-
poration, Harold Blank Corporation, Buddy K. Hughes Land Company, C. Jan
Jennings Land Company, Inc., H. C. L. Land Company, Inc., and West Texas
Construction Company, Inc., their successors and assigns the vendors lien
�i heretofore existing upon the land and premises hereinafter described and the 1
deed of trust whereby the above parties granted, sold and conveyed to John L.
Scott, Trustee for the City of Lubbock, beneficiary the lands described parti-
cularly as follows:

A tract of land containing 156. 700 acres out of Section 5, Block A,-- —;j
Lubbock County, Texas, (except ten acres which is excluded from
this conveyance as hereinafter described) more fully described by
metes and bounds as follows:
BEGINNING at the Southwest corner of said Section 5, Block A,
Lubbock County, Texas, which point is a square head bolt; i
THENCE North 89037145" East a distance of 2648.7 feet to a 3/4 E
inch iron Pipe being the Southeast corner of the Southwest 1/4 of
said Section 5, Block A;

THENCE North 0032145" West, 2291.5 feet to a 5/8 inch rod in the
South right of way line of the proposed highway, Loop 289;
THENCE North 70025145" West 621. 6 feet along the proposed right '
of way line of said highway to a point;
THENCE North 78051145" West a distance of 1196. 1 feet along the
South proposed right of way line of Loop 289 to a point; said point j
y being in the South line of Meadowbrook Drive;
I THENCE North 25024115" West a distance of 100 feet to a point in
the Southeast right of way line of the Panhandle and Santa Fe Rail-
road right of way line;

THENCE South 64035145" West along the Southeast right of way line
of the said railway a distance of 927. 12 feet to railway spike set in
the West line of said Section 5, Block A;
THENCE South 0019°15" East along the West line of said Section 5,
Block A, a distance of 2440.3 feet to the POINT OF BEGINNING.
Provided, however, the following described tract of land which forms
a part of the above-described tract of land, is hereby excepted from
this conveyance and title thereto is retained by the City of Lubbock,
to-wit;
BEGINNING at a point 790.0 feet North 89037145"EAst of the South-
west corner of Section 5, Block A, for the beginning point of this
tract;
THENCE North 0032145" West a distance of 660 feet to a point for
the Northwest corner of this tract; I
THENCE Easterly parallel to and 660 feet North of the South line of
Section 5 Block A a distance of 660 feet to a point for Northeast

corner of this tract;

THENCE Southerly parallel to and 660 feet East of the West line of
this tract to a point in the South line of said Section 5, Block A,
which point is North 89037145" East a distance of 1450 feet of the
Southwest corner of said Section 5, Block A, for the Southeast corner

SECTION 2. The City Secretary is authorized and directed to attest the
signature of the Mayor to the release of lien and shall affix the seal of the City j
of Lubbock thereto, i

COUNTY OF LUBBOCK, KNOW ALL MEN BY THESE PRESENTS:
That in consideration of the payment in fall according to the face and
tenor thereof. of one certain promissory note dated January 10. 1959. in the
principal saw of $74,597.00 payable in the manner and with interest as provided
in said note, described in a certain Deed of Trust. executed by Willo)ack
Corporation. Harold blank Corporation. Buddy K. Hughes Land Company. C. Jan Jennings
Land Company, Inc.. H. C. L. Land Company. Inc.. and Nest Texas Construction
Company. Inc. to the City of Lubbock. a Home Rule Nunicipality. dated the 10th
day of January. 1959. and recorded is Vol. 290. at Page 25. of the records ofDeeds
of Trust of Lubbock County. Texas. THE CITY OF LUBBOCK, a dome Rule Municipality.
duly organized and existing under the Laws of the State of Texas. acting by and
through its duly authorised undersigned officers, the owner and holder of said
note. does hereby release the Deed of Trust lien shown by said instrument to exist
upon the following described property. to secure payment of said note. viz.:
A tract of land containing 156.700 acres out of Section 5. Block A,
Lubbock County. Texas. (except ten acres which is excluded from this
Conveyance as hereinafter described) more fully described by metes and

tract to a point in the South line of said Section 5. Block A. which point

and the vendor's lien reserved in the Warranty Geed dated January 10, 1959, recorded
in Val. 724. Page 251. geed Aecordt of Lubbock County, Texas, additionally securing
payment of said note is also released hereby.
IN WITNESS WHEPEOF, the sold City of Lubbock, a Home Rule Municipality
has caused the instrument to be executed by its duly authorized officers. at
Lubbock. Texas. this day of January. A.D.. 1962.
