HomeMy WebLinkAboutResolution - 110961J - Joint Release - Pioneer Pavers Inc - Multiple Locations - 11_09_1961 JPBgwg RESOLUTION— WHEREAS, heretofore the City of Lubbock passed Ordinance 3180 such "= Ordinance being recorded in Volume 801, Page 375 of the Deed Records of Lubboc County, Texas, and such Ordinance assessed a lien upon property abutting cer- tain streets described therein; and, WHEREAS, one of the subunits as listed in such Ordinance.was not con- structed and such improvements have created no liens against thhproperty assessed by reason of the fact that such paving improvements have not been made and there is no immediate plan of making street improvements upon such subunits; and, WHEREAS, it is expedient to remove the cloud and apparent lien placed upon the title of the property abutting the streets to be improved which were included in the subunit hereinafter listed; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute a joint release with Pioneer Pavers,'Inc., of the follow- ing subunits at the location specified as set out in Ordinance No. 3180, which subunit being released is described as follows: ---------------------------- --------------------------- Pavin Unit ------------ Location -------------- Unit 1995-6 Slide Road from 42.9t South of the S.P.L. of Brownfield Road to 51 South of the alley South of 34th Street. Unit 2016-2 Avenue W from the N.P.L. of 1st Street to the S.P.L. of the Raalroad Right-of-way. Unit 2017-1 21st Street from the W.P.L. of Oxford Avenue to the E.P.L. of Nashville Avenue. Unit 2017-3 Kenosha Avenue (Louisville Ave.) from 571. North of the N.P.L. of 50th Street to 12t N ort of the S.P.L. of 54th Street. Unit 2017-9 Raleigh Avenue from 5t North of the N. P.L. of 35th Stree t to the N.P.L. of 36th Street. Unit 2017-10 Raleigh Avenue from the S.P.L. of 36th Street to 51 North of the N.P.L. of 37th Street. -------------------------------------------------------- SECTION 2. THAT the City Secretary of the City of Lubbock is authorized and directed to attest the Release for the City of Lubbock. SECTION 3. THAT such Release shall affect only property abutting on streets included in the subunits above-mentioned as embodied in Ordinance No. 3180 of the City of Lubbock and such Release shall release only the property specifically described therein. 9th November Passed by the Commission this day of 1961. CASEY, Mayor Fo—Pprov Lr2.venia Lowe, Ci1Cy 3`ecretary-Treasurer Imly arrwe THE STATE OF TEXAS I PAVING RELEASE (JOINT) COUNTY OF LUBBOCK WHEREAS, heretofore on July 13. 1960, the City of Lubock passed Ordinance No. 3180, such instrument being recorded in Volume 901, Page 375, of the Dead Records of Lubbock County, Texas, such Ordinance con- taining a notice bf improvements and apportionment of costs of such im- provements, by assessing a lien upon the property abutting thereon, and in such Ordinance there was included paving assessments for certain herein- after described Paving Sub-Units or Leave-QuOi and, WHEREAS, under such Paving Sub-units or Leave-outs, such improve- ments have created no lien or liens egaintst the property assessed pursuant to said Paving Sub-units or Leave-outs, by reason of the fact that such paving improvements have not been made and there is no immediate plan of making street improvements upon the streets under said Paving Sub-units or Leave- outs, and it is expedient to remove the cloud and apparent lien placed upon the title of property abutting the street as aforementioned: NOW THEREFORE: KNOW ALL MEN BY THESE PRESENTS: THAT the City of Lubbock, acting by and through its officers heretofore duly authorized, in consideration of the premises, the City of Lubbock and Pioneer Pavers, Inc., Contractor do hereby and by these presents, RELEASE, RELINQUISH and FOREVER QUIT CLAIM to the owner or owners of property affected by the paving assessment liens hereinabove mentioned. their heirs, administrators, executors and assigns. all right, title and interest it may have in and to all those lots. tracts or parcels of land abutting property lying and being situated in the City of Lubbock. This Release affects only the property hersinabove described and in no way affects any property or liens not specifically described herein, and all liens and apparent liens against property owners not otherwise released are hereby expressly retained.
