WHEREAS, the City Commission finds that the five (5) foot strip of land
f hereinafter more particularly described has heretofore been abandoned, vacated
and closed and is no longer necessary for street purposes or for any other pur-
pose in the public interest; and,
WHEREAS, the owners of said strip of land have requested that the City
execute to them a Quit Claim Deed to said strip in order to clear up any confusion
as to the title of said strip which now may exist in the deed records; and, the
City Commission finds that it is necessary and expedient and.in the public interes
that said Quit Claim Deed be executed; NOW THEREFORE:

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Mayor be and he is hereby authorized and directed
for and on behalf of the City of Lubbock to execute and deliver to William Alvin
Davidson and Joseph Hall Davidson, for a consideration of ONE AND NO1100 E
($1.00) DOLLARS the attached Quit Claim Deed, the same being incorporated 1
herein by reference for all purposes, conveying all its right, title and interest
in and to that certain tract or parcel of land lying in the City of Lubbock and
State of Texas, and more particularly described by metes and bounds as follows:

jBEGINNING at the Southeast corner of Lot Nine (9), Block
Five (5), South Side Addition to the City of Lubbock, Lub-
bock County, Texas, as that corner is shown according to the
' instrument of dedication and plat of record in Volume 26 at
Page 119 of the Deed Records of Lubbock County, Texas;
THENCE West thirty (30) feet to a point, the beginning point
i of this tract;
THENCE West five (5) feet to a point, the Southwest corner
�` of this tract;
I THENCE North forty (40) feet along the line parallel to the
West boundary line of Block Five (5), South Side Addition to
the City of Lubbock, Texas, to a point the Northwest corner
of this tract; !

{ THENCE East five (5) feet to a point, the Northeast corner of
this tract;
THENCE South forty (40) feet along the line parallel to the West
boundary line of Block Five, (5). gouth Side Addition to the City
of Lubbock, Texas, to the PLACE-OF BEGINNING.
SECTION 2. THAT the City Secretary-Treasurer is hereby authorized and
directed to attest the signature of the Mayor to said Quit Claim Deed affixing the
seal of the City of Lubbock thereto.

That the City of Lubbock, a Municipal Corporation,
acting herein by and through its officers heretofore duly autho-
rized, of the County of Lubbock and the State of Texas, for
and in consideration of the sum of ONE DOLIAR ($1.00) to it in
hand paid by WILLIAM ALVIN DAVIDSON and JOSEPH HALL DAVIDSON,
of the State of California, and of the County of Lubbock, Texas,
respectively, receipt of which Is hereby acknowledged, do by
these presents, BARGAIN, SELL, RELEASE, and FOREVER QUIT CLAIM
unto the said WILLIAM ALVIN DAVIDSON and JOSEPH HALL DAVIDSON
themselves, and their heirs and assigns, all its right, title
and interest in and to that certain tract or parcel of land
lying in the City of Lubbock and the State of Texas, and more
particularly described by metes and bounds as follows:
BEGINNING at the Southeast corner of Lot
Mine (9)), Block Five (5), South Side: Addition
to the City of Lubbock, Lubbock County, Texas,

ment of dedication and plat of record in
Volume 26 at Page 119 of the Deed.Records of

THENCE West thirty (30) feet to a point, the

(This Deed is executed by way of correction,
so as to clarify that the City of Lubbock claims
only the Ea at thirty (30) feet of the original
Lot Wine (9), Block Five (5), South Side Addition
to the City of Lubbock, Texas, as the same was
originally dedicated, and only said thirty (30)

TO HAVE AND TO SOLD the said premises, together with all
and singular the rights, privileges and appurtenances thereto in
any manner belonging unto the said WILLIAM ALVIN DAVIDSON and
JOSEPH HALL DAVIDSON, and their heirs and assigns forever, so
that neither the said City of Lubbock, nor its successors nor
its assigns, nor any person or persons claiming under it shall,
at any time hereafter, have, claim or demand any right or title
to the aforesaid premises or appurtenances or any part thereof.

Dear John:
You will find enclosed the original and several copies
of the quitclaim deed which I discussed with you in your office
last week and which we need the City Commission to pass at its
meeting this Thursday.
It is my presumption that you would be the one to pre-
sent it to the City Commission and I am accordingly forwarding
it to you. If you have any difficulty in this respect or there
is some question in your mind as to whether or not the Commission
can do it this Thursday, I would appreciate it if you would call
me.
