HomeMy WebLinkAboutResolution - 101261C - Release Of Paving Lien - Sub-Unit 2 Of Unit 2016 - Avenue W - 10_12_1961 TMG wg RESOLUTION A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE FOR THE CITY OF LUBBOCK, TEXAS, A RELEASE OF THE PAVING LIEN UPON SUB-UNIT ~' NUMBER TWO OF UNIT NUMBER 2016 LOCATED ON AVENUE "W" FROM THE NORTH PROPERTY LINE OF FIRST STREET TO THE SOUTH PROPERTY LINE I {( OF THE PANHANDLE AND SANTA FE RAILWAY RIGHT-OF-WAY. WHEREAS, heretofore on July 13, 1960, the City of Lubbock passed Ordin- ance Number 3180, such instrument being recorded July 19, 1960, in Volume 801, page 375 of the Deed Records of Lubbock: County, Texas, such ordinance contain- ing a notice of improvements and apportionment of costs of such improvements, b . ass@ssing a lien upon the property abutting thereon, as in such ordinance there wa included paving assessments for the certain hereinafter described Paving Sub- eit; and, WHEREAS, under such Paving Sub-unit in truth and in fact improvements have not been made and there is no immediate plan of making street improvements upon the street under such Paving Sub-unit; therefore, it is expedient to remove r� the cloud and apparant lien placedupon the title to property abutting the street - within such Paving Sub-unit; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor be and he is hereby authorized and directed to execute a Release of the lien as limited to the specific property affected by the paving assessment liens created by, and described as follows, to-wit: Sub-Unit Number Two (2) of Unit Number 2016 Avenue "W" from the North property line of First Street to the South property line of the Panhandle and Santa Fe Rail- way right-of-way. AND, also described in Ordinance Number 3180 passed July 13, 1960, and j filed for record July 19, 1961 and recorded in Volume 801, Page 375, Deed Re- cords of Lubbock County, Texas. t Passed by the City Commission this 12th day of October, 1961. CASEY, Mayor, to release the certain lien here- inafter described, reference being made to said Resolution of appointment- now of record in bookpage of the minutes of the City Com- mission of the City ofTuMbock, Te_xa_e_; WW THEREFORE: KNOW ALL MEN BY THESE PRESENTS: THAT the CITY OF LUI3BOCK, acting by and through its Mayor, here- tofore duly authorized, in Consideration of the premises, the CITY OF LUBBOCK and Pioneer Pavers, Inc., Contractor, do hereby and by these presents, RE- LEASE, RELINQUISH AND FOREVER QUIT CLAIM to the owners or owner of property abutting and affected by thepaving assessment Liens herein mentioned, their heirs, administrators, executors and assigns, all right, title and interest It may have in and to all lots, tracts or parcels of land abutting property lying and being situated in the City of Lubbock, Lubbock County, Texas, and being particularly described as follows, to-wit: Sub-Unit Number 2 of Unit Number 2016 on Avenue "W" from the North property line of First Street to theSouth property line of the Panhandle and Santa Fe Railway right-of-way, said Sub- Unit being included in the Assessment Ordinance Number 3180 passed by the City Commission on the 13th day of July, 1960 and recorded on the 19th day of July, 1960 in Volume 801, page 375, Deed Records of Lubbock County, Texas. however, THAT, this Release affects only the property hereinabove described and in no way affects any property or liens not specifically and expressly des- cribed herein, and all liens and apparent liens against property owners not otherwise released are hereby expressly retained.
