HomeMy WebLinkAboutResolution - 101261A - Release Of Paving Lien - Sub-Unit 2 Of Unit No. 2016 - Avenue W - 10/12/1961 rMG wg RESOLUTION A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE FOR THE CITY OF LUBBOCK, TEXAS, A RELEASE OF THE PAVING LIEN UPON SUB-UNIT i NUMBER TWO OF UNIT NUMBER 2016 LOCATED ON AVENUE "W" FROM THE NORTH PROPERTY LINE OF FIRST STREET TO THE SOUTH PROPERTY LINE OF THE PANHANDLE AND SANTA FE RAILWAY RIGHT-OF-WAY. WHEREAS, heretofore on July 13, 1960, the City of Lubbock passed Ordin- 1 ance Number 3180, such instrument being recorded July 19, 1960, in Volume 801,l page 375 of the Deed Records of Lubbock:.'County, Texas, such ordinance contain- ing a notice of improvements and apportionment of costs of such improvements, b ` ass2ssing a lien upon the property abutting thereon, as in such ordinance there wa included paving assessments for the certain hereinafter described Paving Sub- nit; and, WHEREAS, under such Paving Sub-unit in truth and in fact improvements have not been made and there is no immediate plan of making street improvements upon the street under such Paving Sub-unit; therefore, it is expedient to remove the cloud and apparant lien placedupon the title to property abutting the street within such Paving Sub-unit; NOW THEREFORE: I BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor be and he is hereby authorized and directed to execute a Release of the lien as limited to the specific property affected by the paving ! assessment liens created by, and described as follows, to-wit: Sub-Unit Number Two (2) of Unit Number 2016 Avenue i "W" from the North property line of First Street to the South property line of the Panhandle and Santa Fe Rail- way right-of-way. AND, also described in Ordinance Number 3180 passed July 13, 1960, and filed for record July 19, 1961 and recorded in Volume 801, Page 375, Deed Re- ! cords of Lubbock County, Texas. The City of Lubbock, grantor herein, hereby reserves unto itself the water rights in and to all underground and/or percolating waters in and under the tract or parcel of land herein conveyed, except that the grantees herein or their suc- ceeeore in title may drill and maintain one water well per lot as located on the ground in accordance with a recorded plat of any part of the tract of land herein conveyed which plat has been approved by the Planning and Zoning Commission of the City of Lubbock, Texas, for domestic water usage only, each of said wells to have a capacity not to exceed ten gallons of wateraer minute; and, it is further stipulated that the grantor does not reserve any rights of ingress, egress, or regress for the purpose of taking and for capturing water pursuant to water rights herein retained.
