HomeMy WebLinkAboutResolution - 091461B - Finance Director Authorization - Permits For Limited Sales, Excise & Use Tax Act - 09_14_1961 PAM lyk ,6 RESOLUTION WHEREAS, the legislature of the State of Texas has passed into law a "Limited Sales,, Excise and Use Tax" playing a 2% tax on the sale, rental, lease or other use of tangible personal property; ands, WHEREAS, tangible personal property purchased by a political sub- division such as the City of Lubbock are exempted from the payment of such sales tax& providing that an exemption certificate is filed with the seller by said purchaser; and+. WHEREAS,, as an incident to reporting the collection of taxes on tangible personal property sold by,the City of Lubbock, that the City of Lubbock obtain such permit or permits .required by said " Limited Sales. Excise and Use Tax Act"; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION I. THAT the Director of Finance is hereby authorized for and on behalf of the City of Lubbock, to prepare and file such applications and reports, and to obtain for the City such permit_ or permits as may be required by said "Limited Sale soExcise and Use Tax Act. " SECTION II. THAT the City Manager is authorized to designate such officers, department heads or employees as to him appears necessary, to sign on behalf of the City of Lubbock any and all exemption certificates and <pr resale certificates necessary to acquire for the City of Lubbock all lawful tax advantages provided under said "Limited Sales., Excise and Use Tax Act;" provided, however,, that the form and applicability of all such certificates shall be first approved by the City Attorney or his designated ,assistants.
