A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE FOR THE CITY OF LUBBOCK, A RELEASE OF A PAVING LIEN UPON LOT 20, BLOCK 5, J. C. DAVIS SUBDIVISION, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS. WHEREAS, heretofore, the City of Lubbock, a Home Rule Municipality, in Lubbock County, Texas, filed of record Ordinance No. 1908 on the 21st day of June, 1956, in Volume 622, Page 323 of the Deed Records of Lubbock County, Texas, which Ordinance contained a notice closing hearing and levying assessmen for a part of the cost of improving certain described streets within the City of Lubbock upon property abutting and adjoining thereon; and, WHEREAS, Ordinance No. 1908 has created a cloud and apparent lien upon the title to the prop- described as follows; to-wit: That portion of said property so levied upon being partic- ularly that portion known as Lot 20, of Block 5, J. C. Davis Subdivision, an addition to the City of Lubbock, Lub- bock County, Texas. WHEREAS, it appears that assessment Ordinance No. 1908 in fact and in law has created no lien against the above described property for the reason that the described property constituted the homestead of Louis F. Lang, Jr., and wife, 1 Geraldine Lang, as shown by the statement and affidavit submitted, and that no written instrument was ever executed by Louis F. Lang, Jr., and wife, Geraldine Lang, fixing a legal iien on the described property;.and, . WHEREAS, the present owner has requested and is desirous of obtaining a release of all that property being above described by a proposed release to be executed by the Mayor of the City of Lubbock; and, WHEREAS, it is expedient and to the best interest of the City of Lubbock, and to the present owner of the described property that the cloud be removed from sai property and the purported lien be released; NOW, THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Mayor be and he is hereby authorized to execute a release of the lien as limited to the specific property described herein. Lang, Jr., and wife, Geraldine Lang, their heirs and assigns, any lien by reason of said Ordinance No. 1908 or any 1 �!✓1Z�e. purported paving assessment on and to a certain tract and parcel of land situated in the County of Lubbock, Texas, but Without prejudice to any i/ public'pr private right, title, estate, interest, claim and demand not herein specifically set fort, said certain tract and parcel of land being bounded and described as follows, to-wit: That portion known as Unit 1850-12 Lot 20, Block 5, J. C. Davis Subdivision, an addition to the City of Lubbock, Lubbock County, Texas, fronting 132.5 feet on the West side of Avenue L. and hereby release all right, title, estate, interest, claim and demand said City of Lubbock may have in and to the specific property described herein pursuant to the said Ordinance No. 1908 and the pawing procedures followed for the improvements set forth in said Ordinance No. 1908, but this release does not and shall never be construed as being a receipt or acknowledgement of payment of the principle and interest due on the paving certificate issued by virtue of Ordinance No. 1908 or release of any cause of action based on said certificate as evidence of assessment.
