RESOLUTION
r
WHEREAS, the City Commission has found it necessary to lease
additional space for City and other purposes to alleviate crowded con-
ditions upon the City Hall Block, under the terms and conditions of the
attached Lease between Retha R. Martin and J. B. Hoskins, owners of
Lots 19 and 20 in Block 86, Original Town of Lubbock, together with
the brick building and appurtenances situated thereupon, said Lease
being for one (1) year at $500.00 per month rental;--NG iF,�iTHERE'FORE:
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the Mayor BE, and he is hereby authorized to execute said
Lease as approved by the City Attorney as and when the same has been
executed by the above named lessors.
Passed by the Commission this 23rd day of March
1961.

This indenture. made the 23rd day of March 1961, between
RETHA R. MARTIN end J. D..`H 9 M, .owners of the herein demised pro-
perty, lessors, and the CITY OF LUBBOCK, lessee, witnesseth, that in
consideration of the covenanto herein contained to be.kept and performed
reppectively by the parties stated, lessove do hereby demise and lease unto
lessee certain lots with the building thereon, situated and being Late 19.and

with the brick building, premises and appurtenances,. to have and to hold:the

It to understood that.the,premises are being leased by lessee for such
purposes as lessee by its Governing Body may deteraaine to use the build*
tag and premises for, and that lessee may i,n,its discretion lease. rent or
assign all or any part of said building or premises. 'It is further understood
that lessee may make changes in the building and premises, and such changes
or modifications ate hereby expressly authorised by lessors. Lessee shall
have the right to remove all,additions and other improvements placed therein
by lessee, and in this connection, lessee covenants that it will at the expira-
tion Mihe term. peaceably yield up Canto lessors all and singular.. the premises
in the same repair in all respects that the same is now in. reasonable use and
wearing thereof and damage by accidental fire or inevitable accident only
excepted.
And provided also. in case.the premises or any part therof shall during
the ould term be destroyed or damaged by fire or inevitable accident. ,so
that the same shall be thereby rendered unfit for use and habitation, then and

according;to the nature and extent of injury sustained, shall be suspended or
abated until lessors, their heirs or assigns shall have put said premises in
proper condition and use and habitation by lessee, its tenants or assigns,
-- otherwise these presents shall thereby be terminated and ended at the elec-
tion of lessee.
Lessors covenant that lessee shall have. and is hereby placed in posses-
sion of said demised premises, and that during such term lessee. paying the
rent aforesaid, and performing the covenants herein contained on lessee's
part, to be paid sand performed, shall peaceably'hold and enjoy the said pre-
mises without hinderance or interruption by lessors or any other person or
persons whomsoever.
IN WITLESS WHEREOF, the said parties have executed th is lease at
Lubbock, Texas,the day hereinabove first mentioned.
