HomeMy WebLinkAboutResolution - 020961B - Ensure Housing Of Families Displaced By URA Coronado Project R-33 - 02_09_1961 O R E S 0 L U T 1 0 N WHEREAS, the City of Lubbock and the Urban Renewal Agency of the City of Lubbock have undertaken a program of slum clearance* redeve- lopment and rehabilitation known as the Coronado Urban Renewal Project; and, WHEREAS* the Texas Urban Renewal Law requires as a prerequisite for the approval of an urban renewal plan for a project area* that governing body of the city must find that "a feasible method exists for the loca- tion of families or Individuals who will be displaced from the urban re- newal area in decent* safe and sanitary dwelling accomodations within their means and without undue hardship to such families or Individuals"; and, WHEREAS;', the Federal Housing Act of 1949, as amended through 1959 requires that loan-and capital grant contracts made between the local Urban Renewal Agency and the Federal Government shall require: "There be a feasible method for the temporary relocation of families displaced from the urban renewal areal and that there are or are being provided in the urban renewal area or in other places not generally less desira- ble in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families dis- placed from the urban renewal area decent, safe and sanitary dwellings equal to the number of and available to such displaced families and reasonably accessible to their places of employment;" and WHEREAS, the construction of these aforementioned dwellings should coincide in timing with the relocation of familless and* WHEREAS* the City Commission of the City of Lubbock has received definite assurance from builders and rental unit operators that the aforementioned dwellings will be constructed and rented to such dis- placed families at rents which are within the economic means of said families; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCKr TEXAS: SECTION 1 . THAT the City of Lubbock will take appropriate steps to insure that all families displaced by action of the Coronado Urban Renewal Area are offered decent, safe and sanitary housing within their economic means. To assist In accomplishing the above the City will authorize the City-County Welfare Department to handle all problem cases referred to them by the Lubbock Urban Renewal Agency (Coronado Project R-33) on a �., priority basis; also these additional steps will be taken: (a) Appoint special committee composed of representatives from the Urban Renewal Agency* City-County Welfare Department and Texas Employment Commission to review needs of displaced families (1) those not meeting regular welfare requirements, and (2) families eligi- ble for welfare payments but whose totalability to pay for shelter (including both regular welfare �., shelter allowance and ability-to-pay for shelter from own income) is less than the minimum rent of standard housing available. (b) Authorize City-County Welfare Department to carry out recommendations of above committee to extent necessary to insure the relocation of such families in housing that meets standards in Section 2. (c) Funds will be appropriated and kept available as welfare money to accomplish the actionsthus determined as neces- sary for relocation of such families. SECTION 2. THAT decent, safe, and sanitary housing within the economic means of the family to be displaced shall be housing which meets the provisions of the Minimum Housing Standards Ordinancef and further shall be housing whose gross monthly cost is within the economic ability of the family to pay. SECTION 3. THAT the City of Lubbock will assume no responsibility for the relocation of a family which is evicted by the Urban Renewal Agency of the City of Lubbock for any of the following reasons: a■ A family falls to recognize its obligation to pay rent for a site dwelling. b. A family Is maintaining a nuisance or using the premises for an Illegal purpose. C. A family otherwise commits a material violation of the provisions of the rental agreement. d. A family refuses to consider accommodations which, in the ,judgment of the Urban Renewal Agency of the City of Lubbock, meet the local standards and are suitable for the family„ e. A family completely fails to cooperate with the Urban Renewal Agency of the City of Lubbock. An example of such failure to cooperate would be refusal to admit a relocation Interviewer to Its home, coupled with persistent evasion of attempts made by the Urban Renewal Agency of the City of Lubbock to reach the family by other reasonable means.
