Best Scan Possible. - 12_22_1959 Best Available Scan p `' e� .` RESOLUTION WkEREAS'0' pursuant to Ordinance No. 2435 .Kerr and Middleton, Inc. has completed all paving to be done pursuant to said Ordinance which is contemplated to be deaep. and Kerr and Middleton has been fully paid by the City of Lubbock for all of said paving improvements- and;, 17 1 � W-HEREAS* certain street improvements have not been made or .are such improvements, intended to be made as regards. certain Paving; Subunits or Leave- outs pursuant to Ordinance Nov 2:4.35, and therefore as to ,any apparent lien or cloud of title created,by the assessment for said .Paving Subunits or Leaveouts, same should.be released; NOW THEREFORE BE IT RESOLVED BY THE CITE' COM1,4ISMON OF THE CITY OF L'UBBOCK: SECTION L The performance of Kerr and Middleton, Inc:.,, under Ordi- nance 2435 as to paving improvements has been. completed, and all units co, - pleted have heretofore been accepted and the Cityls share of such paving costs have been fully paid. SECTION Z. The ';mayor is authorized and directed to execute for and on behalf of the City of ,Lubbock a Joint, Paving Release with Kerr and Middleton, .. Iric., covering certain Paving Subunits or Le.aveouts pursuant to Ordinance No. 2435., all as described in said release, a copy of which is attached to. and made a part of this resolution. SECTION, 3. The City Secretary shall attest the signature of the Mayor to said release and shall affix the seal, of the City of Lubbock thereto. Final inspection has been made of the abovementioned improve- ments and said improvements have been constructed in accordance Frith plans, specifications and contract documents. We now request a final inspection of all completed Sub-units by theDirector of Public Works and a Certificate of Completion. Kerr, who being by me duly sworn, upon oath says: I, James C. Kerr, President of Kerr & Middleton, Inc. to represent to the City of Lubbock and solemnly swear that I executed a Contract with the City of Lubbock, .said contract being dated January 29, 1958, for paving improvements under General Work Carder No. 2155, and that the work and contract has been completed according to the plans and specifications pertaining to the project and that all labor, material, supplies and other cost including equipment, rental and hare, and all expense items incurred ffn connection with said project have been paid in full; that all liens and rights to fix liens against any part of said project or the moneys, bonds, or warrants due the Contractor, have been satisfied by payment to the claimant, his authorized agent or attorney, and full release of all recorded liens or claims have been secured by settlement and duly filed of record with the County Clerk of Lubbock County. I further represent and affirm that all Federal, State and municipal laws were substantially complied with by me in doing and carrying out the job and project herein referred to and that I paid applicable scale of wages, and this affidavit is made to secure payment from.the City of Lubbock to me of the full and final moneys due me under this contract.
