the State Highway Com, 1`64ions h4,ve entered inter ,a contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated. Civil Statutes, providing
for the location.;tmatruction and maintenance of that part of the State Highway,'
system, which has heretofore been designated as Loop 289 by the State High-
way Coitmni s sion; and,
5 WHEREAS, under the terms of .the contract the procurement .and. :cquisiti
of the necessary land needed for road right of way purposes is the obligation of th.
City of Lubbock; and.,
WHEREAS, the. State Highway Commission has deemed it necessary in order
to make certain, 1#gghway improvements in connection with said "Loop 28911 situate
in and adjacent to'the. City of Lubbock and to the end that this purpose be accom-
plished, the necessity of which is hereby confirmed by the City Commission of
the City of Lubbock. it is necessary that fee simple title to the land hereinafter
described be acquired by the City of Lubbock :in .fulfillment and satisfaction of
its contractual obligations to the State of Texas; and,

and maintenance of said Loop.289 and the value and total damages'to the owners
for the fee sintple title to said .land have been appraised in the amount of
11,235.- and the Commission finds said amount to be fair and
equitable; NOW THEREFORE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:'
THAT the fee simple title to the following described, land Situated tin Lub-
bock Count ,:,,.Texas,- be acquired by the City of Lubbock for and on behalf of
the State of Texas for the purpose of opening, constructing and maintaining in.
conjunction with the State Highway Commission, said "Loop 289" as. a designated
part of the-State Highway* System, which land is more particularly described
as follows,
A parcel of lard out of the crest half of the southeast one. quarter,
Section 44, Black AK, conveyed to Karl Wolf, etal, by deed dated. �
Mar„, 144 and recorded in vo;- 289, page 54 of the deed records of
Lubbock County, Texas, and being more particularly de.�cii:bed az fol-
low&:
Beginning at the point of intersection of the east bou.ndciry line of
the west one-half of the southeast one-quarter of Section 44, and the
notth boundary line of 34th Street, said corner is 40 feet and 1320
feet crest of the southeast corner .of Section 44;
THENCE S 890 59' W, 344.7 feet;
THENCE B 0° 01' W, 20 feet to a point in a curve, said point is S 0101'
E, 215 feet from the ceaiter of stsLi.d curve;
THENCE Northerly along said curve to the left, a distance of 343.4 fee ;
THENCE N 1*31' W, 692.6 feet to a point in a curve, said point is a
880 29' V, 5879.65 feet from the center of said curve;
THENCE Northerly along said curve to the rig , a distance! of 154.6 feet;
THENCE N 00" Ql' W, 1512.4 feet;
THENCE N 89* 59' E, 150.0 feet to a point in the east boundary line of
the crest one--k l,f of the southeast one-quarter of Section 44;
THENCE S 0° 01' E, 2600.1 feet to the place of beginning and contains
8.988 acres.

THAT the owners of said land be offered, through the Right of Way Deptrt-
maent, the amount :appraised as the value and total damages for the fee simple
title and acquisition of said land for the purposes herein stated, for the use and
benefit of the City of Lubbock and State of Texas, and unless accepted forthwith
the City Attorney is hereby authorized and instructed to institute condemnation
proceedings to ai--tluire= the fee simple title to said land as hereinabove described
for higli ay purposes.
