HomeMy WebLinkAboutResolution - 082759C - Land Acquisition - Jack Schoen Et Al - Section 17 Block A - 08_27_1959 S9 C RESSOLU'TION WHEREAS, the City of Lubbock and the State of Texas, by and through: the State Highway Commission, kx :ve entered into a contract as empowered t , , and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing Z for the location, construction and maintenance of that part of the State Highway` system, which has heretofore been designated-as Loop Z89 by the State High- way Commission; and, WHEREAS, under the terms of the contract the procurement and acquisitioni of the necessary land needed for road right of way purposes is the obligation of AN, City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in orde to make certain hrtghway improvements in connection with said "Loop 289" situate in andadjacent to the City of Lubbock and to the end that this purpose be accom- plished, the necessity of which is hereby confirmed by the City Commission.of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS Jack Schoen, and wife, Mildred and Fidelity Union Life Insurance Company, & Michael Mat € own;or:have some character intere st'.inAand needed for the location,: construction and maintenance of said Loop Z89A'; and the value and total damages`to the owners for the fee sirnple title to said land have been appraised in the amount of and the Commission finds said amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CI-TY OF LUBBOCK:' THAT the fee simple title to the following described land situated'in Lub- bock County, .Texas, be.acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing .and maintaining in conjunction with the State Highway Commission, said "Loop 289" as a designated part of the: State Highway System, which land is more particularly described as follows: 0.059 of one acre of land, being a strip of lz�nd 10 feet in width lying par&Lllel to the present right-of-way line extending from the south property line to the west property line and being a part of Section 17, Block A, Lubbock County, Texas, said tract was conveyed to Jack Schoen by a deed dated 16 Sept. ' 54, of record in vol. 548, page 41, Deed Records of Lubbock County, Texas, which 0.059 of one acre is more particularly described by metes and bounds as follows: BEGINNING at a point on the south right-of-way line of US Hwy. 84, said point is 1595.4 feet ex.ct and 25 feet north of the zouthwest corner of the southeast one-qu&rter of Section 17; THZECE west, 18.E feet, to a point; THENCE N 56049, cif, parallel to the present centerline of US Hwy. 84, 246.9 feet; AMT �i TIiENCE north, 11.9 feet; THENCE S 560 49, E, 268.7 feet to the place of beginning. THAT the owners of said land be offered, through the Right of Way Deport- ment, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title to said land as her.einabove described for highway purposes.
