Cox desires to obtain a license to build a board fence across a portion of the alley lying South of Block 1, J, L. Edwards Subdivision in the City of Lubbock; and, WHEREAS, the City Commission finds that it would be to the public interest and general welfare to grant such license for use of public way; NOW THEREFOR BE .IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor is hereby authorized and directed to sign and execute for and on behalf of the City of Lubbock a License for use of public way granting to Dr. N. A. Cox permission to build and maintain a board fence acro" the alley lying South of Block 1, J. L. Edwards Sub-division, in the City of Luba, bock, Lubbock County, Texas, the location of said fence beginning at a point in the North line of said alley, said point being 250.0 feet Northeast of the South- west corner of said Block 1, J. L. Edwards Sub-division; Thence Southwesterly across said alley to a point in the South line of the alley to a point in the South line of the alley also being the North right of way line of the Panhandle and Sang Fe Railway Co. j SECTION 2. THAT the Gity Secretary-Treasurer shall attest the signature 9f the Mayor to aforesaid License for Use of Public Way and affix the corporate sq of the City of Lubbock thereto. (2) This Licensb is made subject to the condition that LICENSEE, and the heirs, successors, and assigns of LICENSEE will at all times defend, indemnify and otherwise hold the City of Lubbock, its agents, servants and employees harmless of and from any and all claims, demands, actions, causps of action, suits at law and in equity and costs of whatsoever kind or nature which may grow out of or relate to the making of this License or the exercise by LICENSEE of any privileges granted by his License. (3) LICENSEE shall ,at all times exercise the privileges granted by this License in such a manner as will not teate any dangerous or hazardous conditibri'thereon, and subject to the supervision of the Ciiy gineer, LICENSEE shall erect such barricades, warning signs, and other safety devices as rriayte required by said City Engineer at no expense to CITY. LICENSEE accepts the terms, covenants, and conditions of this License and agrees to be bo thereby. In the event two or more parties execute this instrument as LICENSEE, all cove- nants and agreements of this License shall be joint and several convenants and agreements of such parties. (8) All covenants and provisions of this instrument shall be binding upon and inure to the benefit of the successors, legal representatives and aBvigns of the parties to the same extent and effect as same are binding upon and inure to the benefit of-the partiep hereto, but no assignment hereof by LICENSEE, its puccessors, legal representatives or assigns, or any subsequent assi- gnee, shall be binding upon CITY without the written consent of CITY in each instance.
