THAT the Mayor of the City of Lubbock BE and he ishereby auth- orized and directed to execute for and on behalf of the City of Lubbock the attached ELECTRIC TRANSMISSION LINE LICENSE of the Fort Worth and Denver Railway Company which authorizes the construction of a 69KV electric transmission line along the West line of Burlington Industrial District No. 3 from 50th Street to 58th Street, and as shown by exhibit A attached thereto dated May 52 1959. Wilson, City Attorney 3UB.TECT: Power Line Easement, Fort Worth and Denver Railway Company for 69KV Line along the West line of Burlington Industrial District No. 3 from 50th Street to 58th Street. Your memo implies that a part of the right of way covered by the attached electric transmission line license, may be involved in the dispute between the railroad, the radio station and possibly others concerning whether this property remains a county road or was in fact closed by a plat the Planning and Zoning Commission, approved for the railroad. .Apparently the railroad claims ownership of the fee title to this property in which event they would have the right to grant the license. Should this right of way be involved in litigation and turned out to be a roadway opened by the Com- missioners Court, in either event I believe we would be entitled to construct this power line at the described location. This license provides, as all licenses do that the power line will be .removed by the City .at its cost should the licensor require that this be done. I do not fore- see any difficulty at this time but should it occur, I think Mr. Frank Posey should consider the cost of such a change, as compared with the cost of condemning the right of way for the power line use at the location shown on the exhibit attached to the license.
