RESOLUTION
WHEREAS, the City of Lubbock and the. State of.Texas, by and through.
p., the State ,Highway Commission, hove entered into a contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the State Highway'
system, which has heretofore been designated as Loop 289"by the State High-
way Com mission; and,
WHEREAS, under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation of th
City o L, bbock; and,

WHEREAS, the State Highway Commission has deemed it necessary in orde
to make certain highway improvements in connection with said "Loop 2891' situate
;;in end 11sid,acent to'the City of Lubbock and to the end that this purpose be accozn
p1i shed' �'he necessity of which is hereby confirmed by the City Commission:. '

BE IT RESOLVED BY THE CITY COMMISSION OF THE CI-TY OF LUBBOCK:t

THAT the fee simple title to the following described land situated in Lub-
bock County, Texas, be acquired by the City of Lubbock for at�d on behalf of
the State 6f Texas for the purpose of opening, constructing and maintaining in
conjun�tic n with the State Highway Commission, said "Loop 28911 as a designated
part ofIthe State Highway System, which land is more particularly described
,as follo 4:

Bekinning at a point in the west boundary line of said Section 23 ,
being also. the east boundary line of Section 6, Block E, said point
being 13961 feet south of the northeast corner of said Section 6;'
thence in a northeasterly direction along a circular curve to the '
left, the center of the curve being N 12°Q71 Vi, 1111.28 feet from
thie beginning of this call, a distance of 231..4 feet, to a point;
thence N. 65° 571 E, 263.5 feet along aline parallel to and 150 feet
nrthwesterly from the centerline of a proposed freeway as established

a northeasterly direction along a circular curbe to the right, .the center of

THAT the owners of said land be offered, through the Right of Way Depart- 1
ment, the amount appraised as the value and total damages for the fee simple

title and acquisition of said land for the purposes herein stated, for the userand
benefit of the City of Lubbock and 'State of Texas, and unle as accepted forthwith
the City Attorney is hereby authorized and instructed to institute condemnatiori
proceedings to acquire the fee simple title to said land as hereinabove described
for highway purposes.
