WMREAS, The City Commission finds that it would be expedient and in
the public interest to enter into a contract vrith a contract by and between
the City of Lubbock and the Urban Renewal Agency of the City of Lubbock
whereby the City is to make certain structural!: studies: in the 'Fella owhouse;
Urban Renewal. Area. on an actual-cost basis not to exceed '2000.00 to be
paid to said city by said agency; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COTRIISSION OF THE CITY OF LUBBOCSs
Section 1. The Mayor is authorized and directed to execute for and on behalf
of the City of Lubbock a contract to be entered into by and between the Urban
Renewal Agency of the City of Lubbock and the City of Lubbock whereby said City
is to make certain detailed structural surveys in the Yellowhouse Urban Renewal
Area on an actual-cost basis for the Urban Renewal Agency. Said Urban Renewal
Agency shall compensate said city .in an amount not to exceed $2000.00 for such
services and said contract shall bear the date of January 1st, 1959.
Section 2. The City Secretary shall attest the signature of the mayor to said
f contract and shall affix the. seal of the City of Lubbock thereto.

Tits AOREIT entered into as of thia lot day of January, 1059, by and between
the`Urban Renewal Agency of the City of Lubbock, State of Texas, hereinafter referred
to as the "Local Public Agency" and the City of Lubbock, a Home Rule Municipality of
the County of Lubbock, State of Texas, hereinafter referred to as the "Contractor".
WITNESSEM THAT:
WWALAS, the Local Public Agency has, under date of the 30th day of December,
1957, entered into a Contract for Advance with the 'United States of America providing
for financial aid to the Local Public Agency under Title I of the Housing Act. of 1049,
(as ascended prior to .tbe ]bust Act of 1954) (as amended by all amendatory Acts in-
eluding the Housing Act of 1954 ; and,
WEMHEAS, parroant to such Contract the Local Palblie Agency is undertaking certain
activities necessary for the planning or execration of a. Project, situated in the Project
Area described belay; and,
1aHEHEAS, the Local Public Agency desires to engage the Contractor to render certain
technical advice and assistance in connection with such undertakings of the Local Public
Agency.
NOW TIIERLTO E, the parties hereto do mutually agree as followst
1. Sew of SeWces, The Contractor shall perform all the necessary services pro-
vided under this Contract in connection with and respecting the followings Project Area:
Yellovhouse Urban Renewal Area, located in the City of Lubbock, Lubbock County,
Texas, described generally as followst
BEGINNDiG at the intersection of the West line of Ash Avenue with the South
line of Survey S, Block Q, Lubbock County, Texans
TUENCE East alotig< East 19th Street and along the South lime of Survey $,
Block 00" to its intersection with an extension of the Northeast. Sight-
of-Wrap line of Weber Avenue;
JrTHEhCE Southeasterly along the extension of the Northeast Right-of-sway line
of Weber Avenue to its intersection with the proposed North line of East
24th Street;
TMCE East along the proposed North line of East 24th Street to its
intersection with the vest line of Quirt Av*nuej
MNCE slightly 'hest-of-.North along the West line of Quirt Avenue to its
Intersection with the proposed North line of East 22nd: Streets
TaME East slang the proposed Forth line of East 22nd Street to its
intersection with the East line of 8odbud Avenue;

Right-of-Way line of the Panhandle and Santo. Fe Railway Company;

its intersection with the South line of the proposed overpass Street
(proposed to be extended from Enst 28th to East 26th);
THENCE left 901 and proceeding So-ithwesterly along the South line of
the proposed oTorpause street to its intersection with the *forth line
of East 28th Street;
T(IENCE nest aloLg the forth line of East 28th Street to its ,inter-
section with the most lino of Juniper Avenue;
TUME South along the West line of Juniper Avenue to its intersection
with the Northeast Bight-of-way line of the Fort Worth and Denver City
Railway Company;
THENCE N'orthvesterly along the Northeast Right-of-Way line of the Fort
Forth and Deriver City Railway Company to its intersection with a 945,37
radius curve to the right, said curve 'being parallel to and 10 feet
radially distant frcm the center line of an industry track of said rail-
way company which is on a 6 degree curve to the right leading to the
West side of Ash Avenue{
THENCE along the 945.37 radius curve to the right parallel to and 10 feet
radially distant from the center lino of the spur track to the point of
tangency for said 045,37 radius curve, siLid point of taMeney being an
the West line of Ash Avenue;
THENCE North along the West line of Ash Avenue to its intersection with
the South line of Survey 3, Block 10*1 the POINT OF BEGINNING for this
project area;
and shall do, perforua, and carry out, in a satisfactory and proper mariner, as
determined by the Local Public Agency, the followingi

The Building Inspection Department of the Contractor shall do and dorm h
following services pursuant to this Contratti
Carry out and perform such detailed structural studies of representative
structures for determining feasibility of rehabilitation in the Tellowhouse
Urban Renewal Area as may from time to time be stipulated by the Executive
Director of the Urban Renewal Agency of the City of Lubbock.
2. Time of Performance. The services of the Contractor to commonce upon
January 1, 19590 and shall be undertaken and completed in such sequence as to assure
their expeditious completion in the light of the purposes of this Contract, but in Lay
event all of the services required hereunder shall be completed within 90 consecutive
calendar days from the date of this Contract.
9. Coggensation. It is provided that the Contractor shall be compensated for ser—
vices performed under authority of this contract on an actual cost basis by the Local
Public Agency. The Contractor is hereby authorizedto incur coats not exceeding Two
Thousand and No1100 (62000.00)------Dollars In the performance of services and purchase
of materials authorised by this contract, and said sum shall constitute complete com—
pensation for all services to be rendered pursuant to this contract. The Contractor
shall be compensated by the Local Public Agency for use of automobiles owned b the
Contractor and/or under the Contractor's control at the rate of five cents (51� per
mile for each mile of use of said automobiles necessary for the performance of services
authorized by this contract. Accurate records of said mileage shall be kept by the
Contractor and shall be open to inspection by the Local Public Agency.
d. dethed of Payamnt. All items of compensation to be paid to the Contractor
by the Local Public Agency shall be supported by evidence of actual cost including,
but not limited tot purchase orders, drily authenticated time cards showing the amount
of time of employees of the Contractor was allocated to services rendered in urban
renewal work pursuant to this contract, invoices, payroll ledgers, statements, eaneelled
Checks,, and other suitable evidence of expenditures. Such evidence of actual coat shall
be kept and/or filed in its customary location in or near City Hall of the City of Lubbock,
Texas# and shall be available for inspection during normal working hours by any person
authorised by the Local Public Agency to inspect such records.
The Contractor ie heroby authorized to buy, purchase, lease or rent such materials
as are necessary for the performance of services authorized by this contract. The
Local Public Agency shall compensate the Contractor for such materials as are used
and are necessary for the performance of services authorized by this contract. In
no case shall the Local Public Agency compensate the Contractor for the full value of
capital equipment owned by the Contractor unless the total value of said Capital equip—
meat is entirely need up and/or depreciated by the performance of services authorized
by this contract. In use of capital equipment by the Contractor in performance of
services authorized by this contract, the Contractor shall be compensated for that
actual part of the capital equipment depreciated and/or used up in performance of
services authorized` by this contracts provided however, that said compensation for
use of capital equipment shall not be deemed to include use of automobiles or purchase
of expendable Items such as, but not limited to measuring tape, pencils, printed mat—
erial or other such incidentals.
It is expressly understood and agreed that in no event will the total compensation
and reimbursement, if any, to be paid hereunder exceed the maximum sums of $2000.00 for
all of the services .required.
5. Terms and Conditions. This contract is subject to and incorporates the
Provisions attached hereto as Pa t II. Terms and Conditions.
