N BAXTER HONEY AND OTHERS ARE LESSORS AND THE CITY OF LUBBOCK, SSEE, WHEREBY LESSOR LEASES TO LESSEE A TRACT OF LAND OF APPRC MATELY TWELVE (12) ACRES OUT OF SECTION 11, BLOCK E2, LUBBOCK OUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED IN THE BIDDY OF TM' ESOLUTION TO BE USED AS A SANITARY 'FILL. / 7 WHEREAS, Baxter Honey and others are owners of a tract of land in Section 11, Block E2, Lubbock County, Texas, more particularly described herein, on which is s situated an excavation of a volume of .approximately one million cubi6 yards; and, WHEREAS, the owners of said tract have requested the City of;Lubbock to leas said tract and use the excavation as a ;sanitary fill so that it may be filled to the lev f the surrounding ground thereby enhancing the value of the proper�y; NOW THERE FORE: E IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor is hereby authorized and directed to execute for nd on behalf of the City of Lubbock a Sanitary Fill Lease Agreement whereby Baxt : oney, C. W. Honey, Floyd Honey and Glenys Honey, Lessors lease u-41to the City f Lubbock a tract of land to be used as a sanitary fill and as access described as ollows BEGINNING at a point in the lest line of Section 11, Block E2,' said point being 1125 feet North of the ,Southwest corner of said Section 11, Block EZ; THENCE East 1150 feet to a point; THENCE North 700 feet to a point; THENCE West 300 feet to a point; THENCE South 6700+ West a distance of 400 feet to a point, .South THENCE/300471 West a distance of. 159. 8 feet to a point; South THENCEf360 feet to a point; THENCE West 400 feet to a point, said point being in the West Line of said Section 11, Block EZ; THENCE South 40 feet to the PLACE OF BEGINNING. SECTION 2. The City Secretary is authorized and directed to attest the signat f the Mayor to said Sanitary Fill Lease Agreement and shall affix the seal of the ity of Lubbock thereto. It is the under- standing of all parties concerned that payments are to be -made for not in excess of 40 months but the City may continue to .fill the area described in said Sanitary Fill Lease Agreement, without a.ddition4 payment until the contract is fulfilled. Motion was made by Commissioner Maner, seconded by Commissioner Maxey, motion carried, Mayor Baker and Commissioners Casey, Maxey and Ma.ner voting Yea, none voting Nay, to authorize payment of 30 per month .for a period of 40 months to Baxter Honey and others, Lessors in a Sanitary Fill.
