RESOLUTION
WHEREAS, the City of Lubbock and the State of Texas, by and through the j
State Highway Commission, have entered into a contract as empowered and
.-. authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the
location, construction and maintenance of that part of the State Highway system, in
which has heretofore been designated as U.S. Highway 62, commonly known and
designated as the Brownfield Highway and Project No. 380-1-13 by the State High

WHEREAS, under the terms of the contract the procurement and acquisition of
the necessary land needed for road right of way purposes is the obligation of the
City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in order
to make certain highway improvements in connection with said U.S. Highway 62, j
commonly known and designated as the Brownfield Highway 'and Project No. 380- j
1-13 situated in and adjacent to the City of Lubbock and to the end that this pur-
pose be accomplished, the necessity of which is hereby confirmed by the City
Commission of the City of Lubbock, it is necessary that fee simple title to the i
land hereinafter described be acquired by the City of Lubbock in fulfillment and
satisfaction of its contractual 'obligations to the State of Texas; and,
WHEREAS, MITT BULLARD, and wife, NANEMA.Y BULLARD, B. M. LIM- ;
BAUGH, MALCOM S. LIMBAUGH, and FIRST NATIONAL BANK, LUBBOCK, `
TEXAS, R:OY RIDDLE, PRESIDENT owns or has some character interest in land
needed for the location, construction and maintenance of U.S. Highway 62,
commonly known and designated as the Brownfield Highway and Project No. 380-
1-13, and the value and total damages to the owners for the fee simple title to said
land have been appraised' in the amount of $940. 00 and the Commission finds said,
amount to be fair and equitable; NOW THEREFORE, +j
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:

THAT, the fee simple title to the following described land situated in Lubbock
County, Texas, be acquired by the City of Lubbock for and on behalf of the State
of Texas for the purpose of opening, constructing and maintaining in conjunction
with the State Highway Commission, said U.S. Highway 62, commonly known and
designated as the Brownfield Highway and Project No. 380-1-13 as a designated
part of the State Highway System, which land is more particularly described as
follows:
0. 086 of one acre, being a strip of land 10 feet in width lying j
parallel and adjacent to the present Southeast highway right
of way line and extending from the Northeast boundary line of
Lot 5 to the South boundary line of Lot t, Bullard Addition, a
plat of said addition being of record in vol. 478, page 361, Deed
Records of Lubbock County, Texas, said'strip being out of and
a part of that certain tract conveyed to Mitt Bullard by deed
dated 16 Aug. 48, of record in vol. 373 page 342, Deed Records
of Lubbock County, Texas, which 0. 086 of one acre is more
particularly described by metes !and bounds as follows:

line of said Lot 5;

THAT the owners of said land be offered, through the Right of Way Depart--
Pment, the amount appraised as the value and total damages for the fee simple
,w. II title and acquisition of said land for the purposes herein stated, for the use and
benefit of the City of Lubbock and State of Texas, and unless accepted forthwith
the City Attorney is hereby authorized and instructed to institute condemnation
proceedings to acquire the fee simple title to said land as hereinabove described
for highway purposes.
