RESOLUTION ACCEPTING I14PROVEMMENT5 ON PORTIONS OF ALLEYS, STREETS,
AND/OR AVENUES AS LISTED BELOW AND ORDERING THE ISSUANCE OF CERTIFICATES IN
EVIDENCE OF ASSESSMENTS LEVIED.
WHEREAS, the City of Lubbock heretofore passed various street
improvement ordinances and resolutions and entered into contract with Kerr
and Middleton, Inc., G.W.O. 2155 for the making and construction of street
and/or alley improvements on portions of numerous alleys, streets and/or
avenues .in said City including among others the following:
North Detroit Avenue from its intersection with the South Property Line of
Colgate Street (West Leg) to its intersection with the North Property Line of
Baylor Street (N.Leg), known and designated as Sub-Unit Number 2 of Unit
Number 1900.
North Detroit Avenue from its intersection with the South Property Line of
Baylor Street (W.Leg) to its intersection with the North Property Line of
Bates Street (E.Leg), known and designated as Sub-Unit Number 3 of Unit Number
1900. "A
35th Street from its intersection with the West Line of the Nellie Jarrett
Subdivision to its intersection with the East Line of the Nellie Jarrett
Subdivision, known and designated as Sub-Unit Number 8 of Unit Number 1900.
Avenue W from its intersection with a line 2.5 feet South of the South Property
Line of alley South of 49th Street to its intersection with a line 15 feet
North of the North Property Line of 50th Street, known and designated as
Sub-Unit Number. 1:0 of` Unit Number 1900,
Avenue G from its intersection with the South Property Line of 56th Street to
its intersection with the North Gutter Line of Avenue D, known and designated
as Sub-Unit Number 1 of Unit Number 1901.
North Akron Avenue from its intersection with the North Property Line ,of 1st
to its intersection with the South Property Line of Amherst Street, known
and designated as Sub-Unit Number 6 of Unit Number 1901.
North Akron Avenue from its intersection with the North Property Line of
Amherst Street to its intersection with a Line 2.5 feet North of the North
Property Line of alley'- North of Amherst Street, known and designated as Sub-
Unit Number 7 of Unit Number 1901.
53rd Street from its intersection with the West Gutter Line of College Avenue
Access Road to its intersection with a line 3 feet East of the East Property
-.. Line of alley East of College Avenue Access Road, known and designated as
Sub-Unit Number 8 of Unit Number 1901,
Avenue W from its intersection with the South Gutter Line of 46th Street to its
intersection with the North Gutter Line of 47th Street, known and designated
as Sub-Unit Number 12 of `Unit Number 1901.
Avenue W from its intersection with the South Property Line of 38th Street to
its intersection with the North Gutter Line of 39th Street, known and designate
as Sub-Unit Number 15 of Unit Number 1901.
Nashville Avenue from its intersection with the South Property Line of 21st
Street to its intersection with the North Gutter Line of 22nd Place, known
and designated as Sub-Unit Number 20 of Unit Number 1901.
North Hartford Avenue from its intersection with the South Paving Line of
Clovis Road to its intersection with the North Gutter Line of Jarvis Street,
known and designated as Sub-Unit Number 55 of Unit Number 1901.
North Gary Avenue from its intersection with the South Gutter Line of Grinnell
Street to its intersection with the South Property Line of Erskine Avenue,
known and designated as Sub-Unit 22 of Unit Number 1902.
Magnolia Avenue from its intersection with a line 23 feet North of the North
Property Line of East 36th Street (W.Leg) to its intersection with a line
13.5 feet South of the South Property Line of East 40th Street, known and
designated as Sub-Unit Number 3 of Unit Number 1903.
Avenue 0 from its intersection with a line 7.6 feet South of the South Property
Line ok 3rd Street to its intersection with a line 22.7 feet South of the
Panhandle and Santa Fe Railroad Right--of-Way (East side), known and designated
as Sub-Unit Number 5 of Unit Number 1903•
Avenue 0 from its intersection with the North Gutter Line of 4th Street to its
intersection with a ,line 76 feet South of the South Property Line of 3rd
Street, known and designated as Sub-Unit Number 4 of Unit Number 1904.
The North 603.6 feet of alley between College Avenue and Avenue Y and between
16th Street and 19th Street, known and designated as Sub-Unit Number 4 of
Unit Number A 315• .
AND WHEREAS, the improvements upon the said portions of the above-
mentioned alleys, streets and/or avenues, have been inspected and found to
have been construction in accordance with terms of said contract G.W.O. 2155:.
THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS:
1.
That the improvements on said portions of the abovementioned alleys
streets, and/or avenues be and the same are hereby accepted, and the City
Engineer be and he is hereby authorized to direct payment of the Cityfs portion
of the cost.

That the Mayor and City Secretary be, and they are hereby instructed
to execute and deliver certificates in evidence of the assessments levied
against the arcels of property abutting upon the said portions of the alleys,
streets and or avenues listed above and against the owners of such -property in
accordance with law and in the manner provided in said contract, and the pro-
ceedings with reference to said improvements and assessments where such assess-
ments were levied.

This resolution shall take effect and be in force from and after its
passage.

Gentlemen:
I have examined the paving improvements constructed by
Kerr & Middleton, Inc., paving contractor, under their contract dated
January 29, 1955, designated as G.W.O. 2155 and find the improvements
on North Detroit Avenue, 35th Street, Avenue "W", Avenue "G", North
Akron Avenue, 53rd Street, Nashville Avenue, North Hartford Avenue,
Magnolia Avenue, Avenue 1101e, and the N--S alley between College and
Avenue 11YU and from loth to 19th Street as listed on the final estimate
and assessment sheet to have been completed in accordance with the plans
and specifications and recommend that you accept the improvements on
said streets and/or avenues, authorizing payment to the contractor the
amount shown on the attached consolidated final estimate sheet as due
them by the City of Lubbock and issue assignable certificates against
property owners for the respective amounts shown on the attached final
assessment sheets as being due against them and their respective
properties..
