RESOLUTION

WHEREAS, there appears to be need for establishing a regular procedure
applicable to traffic cases tried by the Corporation Court of the ,City of
Lubbock; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
CPS', SECTION 1. THAT the following procedure shall apply to only traffic
cases tried in Corporation Court and that the Judge of the Corporation Court
of the City of Lubbock be requested and is hereby requested to implement
such procedure so that:Upon the trial of a defendant for a traffic offense within the juris-
diction of Corporation Court, if the defendant is found guilty and has not
previously made bond as required by law, and such person is present before
the Court, the Corporation Court Judge shall place the defendant in custody of
the Court,Bailiff rr✓ho „.hef'eby. 'authorized and directed under supervision of
the Corporation Court Judge to give the defendant a reasonable time to see and
or communicate with an attorney or attorneys and/or the defendant's family
and other persons under circumstances reasonably necessary to the making of
a lawful bond or arrangements to pay the fine assessed against him; provided
that in making such communications, and ',a telephone is appropriate, the Bailiff
shall make available for such defendantts ',reasonable use, the telephones in
the office of the Bailiff or the Clerk, and the Bailiff as directed and.acting under
the supervision of the Judge will give the defendant an opportunity to execute
an appeal bond and secure the execution of same by his sureties if such defendant
obligates himself in writing to return within a definite time to the Clerk's office
with and submit for approval and file an appeal bond as provided by law. Should
the defendant refuse to communicate with an attorney or other persons as above
provided and/or prepare a lawful bond to effectuate his release, such defendant
shall be committed as directed by the Judge, as provided by law. Should the-,
defendant fail to pay his fine as provided by the judgment or to make and submit
for approval and file an appeal bond within the time provided by law or other
bond set by the Judge or fail to return under the conditions established by the
' Judge, a capias shall issue for his arrest.
Be It Further Resolved that the City Secretary prepare and deliver to the
Judge of the Corporation Court a copy of this Resolution together with copies to
be delivered by the Court to the Court Bailiff and the Clerk of the Corporation
C ourt.
