HomeMy WebLinkAboutResolution - 102358D - Dedication Deed - Manhattan Heights Addition - 10_23_1958 RESOLUTION__ A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A PLAT AND DEDICATION DEED COVERING LOTS 101 .THROUGH 197 INCLUSIVE, ALL IN MANHATTAN HEIGHTS ADDITION, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS. WHEREAS, the City Commission of the City of Lubbock finds that it would be expedient and in the public interest to plat certain property owned by the City of Lubbock; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor is hereby authorized and directed to execute for and on behalf of the City of Lubbock a plat and dedication deed to Lots 101 and 197 inclusive, all in Manhattan Heights Addition, to the City of Lubbock, Lubbock County, Texas, a copy of said plat and dedication deed being attached hereto and made a part hereof. SECTION 2. THAT the City Secretary :shall attest the signature of the Mayor to said plat and dedication deed and shall affix the seal of the City of Lubbock thereto. There is hereby created, impressed and imposed upon all lots shown upon said map and plat the following covenants which shall run with the land and be binding upon the undersigned and all persons claiming thereunder for a period of fifty (50} years from the date of the execution of this instrument, at which time such covenants shall, without further involvement, be automatically extended for successive periods of ten (10) years unless by vote of a majority of the owners of the lots it is agreed to change such covenants in whole or in part: C O V E N A N T S 1. All lots in this said subdivision shall be known and described as residential lots to be used as residential purposes only, and for private dwell- ings. No commercial enterprise shall be permitted thereon. 2. No trailer, basement, tent, shack, garage, barn or any other structures shall be erected, altered, placed or permitted to remain on residence lots other than detached single family dwellings, with necessary and incidental garage for private family automobiles. 3. No servants' quarters or servants' horses shall ever be created, altered, placed or permitted to remain on any residence lots herein contained. 4. No building shall be located nearer than thirty-two (321) feet to the front lot line nor nearer than five feet to the side lot lines, with the exception of lots 101, 105, 1141 117, 122, 126, and 127, which shall have a ten (101) foot setback line on the side abutting a street, all as shown on the :map attached hereto and made a part hereof. 5. No lot shall be divided into smaller tracts to result in increasing the number of building lots in any block. 6. All main residence buildings shall face upon the street upon which the lot faces. 7. No noxious or offensive trade or activity shall be carried on upon any lot nor shall anything, be done thereon which ray be or become an annoyance or nuisance to the neighborhood. No cows, horses, chickens, hogs or other livestock or poultry shall be kept, cared for, or maintained upon an- lot in the addition. This covenant shall not exclude the keeping of dogs, cats or any domestic pets except that there shall not be kept upon any building lot, any kennels or pens for the keeping of dogs, cats, rabbits or ark, other animal raised for sale or commercial S. No old building or existing structure of any kind shall be moved onto or placed upon any lot in this subdivision. 9. The ground floor area of the main structures exclusive of one-story open porches and garages shall be not less than 900 square feet. No twc-story garage shall be permitted on any said lot. 10. If any grantee hereunder or persons occup,­ing the premises thereunder, or their heirs or aseigns, shall violate or atte:tipt to violate any of the covenants herein, it shall be lawful for the dedicators herein or ..ny person or persons owning any real property situated within said addition to prosecute arr� proceedings at law _2_ r 10236SD or in equity against the person violating or attempting to violate any such covenant, either to prevent him or them fro:a so doing and/or to recover da^aages or other dues for such violation. 11. Any violation of any one of these covenants by judgment or court order or by waiver of non-enforcement or by written stipulaticn shall in no wise affect any of the other provisions which are herein set out, wk:ich said provisions shall regain in full force and effect.
