r �RESOLUTION_
WHEREAS, the City of Lubbock and the State of Texas, by and through
the State Highway Commission, have entered into a contract as empowered and
authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for
the location, construction and maintenance of that part of the State Highway
!system, which has heretofore been designated as U. S. Highway '62, commonly
mown and designated as the Brownfield Highway and Project No. 380-1-13 by
he State Highway Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisi
IIti.on of the necessary land needed for road right of way purposes is the obligation
bf the City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in
;order to make certain highway improvements in connection with said U. S.
;Highway 62, commonly known and designated as the Brownfield Highway and
;project No. 380-1-13'situated in and adjacent to the City of Lubbock and to the
lend that this purpose be accomplished, the necessity of which is hereby confirm-
ed by the City Commission of the City of Lubbock, it is necessary that fee simple
title to the land hereinafter described be acquired by the City of Lubbock in fulfill
'ment and- satisfaction of its contractual obligations to the ;rotate of Texas; and,
WHEREAS, J. H. Dyer, Jr. owns or has some character interest in land
needed for the location, construction and maintenance of U. S. Highway 62,
commonly known and designated as the Brownfield Highway and Project No.
380-1-13, and the value and total damages to the owners for the fee simple title
to said land have been appraised in the amount of $627. 00 and the Commission
finds said amount to be fair and equitable; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated in
Lubbock County, Texas, be acquired .by'the City of Lubbock for and on behalf of
the State of Texas for the purpose of opening, constructing and maintaing in
conjunction with the :State Highway Commission, said U. S. Highway 62, common
known and designated as the Brownfield Highway and Project No. 380-1-13 as a
designated part of the State Highway System, which land is more particularly
described as follows:
BEGINNING at the Northeast corner of a certain tract of land
conveyed to J. H. Dyer, Jr. , by deed dated July 29, 1953 and
recorded in Vol. 506, page 503 of the Deed Records of Lubbock
County, Texas, said point being also 120. 13 feet East and 158. 57
feet North from the Southwest corner of Block 4, John W. Jarrett
Sub-division;
THENCE South 12.4 feet along ihe East boundary line of said tract;
THENCE South 530561 West, 104. 5 feet along a line parallel to and
10 feet Southeasterly from the present Southeast highway right-of-
way line to a point in the West boundary line of said tract;
THENCE North 12.4 feet along said West boundary line to the.North-
west corner of said tract;
THENCE North 53o56r East 104. 5 feet along the said highway right-
of-way line to the. PLACE OF BEGINNING and contains 0. 024 acres.
THAT the owners of said land be offered, through the Right-of-Way
Department, the amount appraised as the value and total damages for the fee
simple title.and acquisition of said land for the purposes herein stated, for the
use and benefit :of the City of Lubbock and State of Texas, and unless accepted
forthwith the City Attorney is b--:reby authorized and instructed to institute
condemnation proceedings to acquire the fee simple title to said land as herein-
above described for highway purposes.
Approved and passed by unanimous vote of the Commission this 9th
day of October 1958
