Jarrett Subdivision - 10_09_1958 RESOLUTION / WHEREAS, the City of Lubbock and the State of Texas, by and through ~' the State Highway Commission, have entered into a contract as empowered and authorized by Art. '6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance of that part of the State Highway system, which has heretofore been designated as U. S. Highway 62, commonly known and designated:as the Brownfield Highway and Project No. 380-1-13 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisi- tion of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said U. S. Highway 62, commonly known and designated as the Brownfield Highway and Project No. 380-1-13 situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirme by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in ful- fillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS, M. H. Day owns or has some character interest in land needed for the location, construction and maintenance of U. S. Highway 6Z, commonly known and designated as the Brownfield.Highway and Project No. 380-1 13, and the value and total damage' to the owner for the fee simple title to said land has been appraised in the amount of $960. 00 and the Commission finds said --. amount to be fair and equitable; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said U. S. Highway 62, common known and designated as the Brownfield Highway and Project No. 386-1-13 as a designated part of the State Highway System, which land is more particularly described as follows: BEGINNING at the Northwest corner of a certain tract conveyed to M. H. Day by deed dated 10 June 1948, and recorded in Volume 372, page 494 of the Deed Records of Lubbock County, Texas, said point being 120. 13 feet East and 158. 57 feet North from the Southwest corner of Block 4, John W. Jarrett Sub- division; THENCE North 530561 East, 159. 83 feet along the M present Southeast highway right-of-way line to the Northeast corner of said tract; THENCE South 1 2.4 feet along the East boundary line of said tract to a point; THENCE South 530561 West,' 159. 83 feet along a line parallel to and 10 feet Southeasterly from said present highway right-of-way line to a point in the West boundary line of said tract; THENCE North 12.4 feet along said West boundary line to Z1FGTNNTNG and contains 0. 037 acres. 1+ THAT the ovrners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, ,,--. for the use and benefit of the City of Lgbbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
