Fleming Et Al - Morning View Addition - 09_25_1958 Fo5v c " r ti y LA FI RESOLUTION i W H E R E A S the City of Lubbock and the State of Texas, by, and through ; the State Highway Commission, have entered into a contract as empowered and !( authorized by Article 6673-b, Vernon's Annotated Civil Statutes, providing for I' 1 the location, construction and maintenance of that part of the State Highway syste which has heretofore been designated as Loop 289 by the State Highway Commissio and, s i WHEREAS, under the terms of the contract the procurement and acquisition ofthe necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said "Loop 289" situated in and adjacent to the City of Lubbock and totthe end that this purpose be accom- plished, the necessity of which is hereby] confirmed by the City Commission of the City of Lubbock,, it is necessary that fee sin�iple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Teas; and, WHEREAS, L. E. Fleming and United Fidelity Life Insurance Company own, or have some character of interest in,land needed for the location, construction and maintenance of said Loop 289, and have ibeen appraised in the amount of $3,913. 00 and the Commission finds sai4 amount to be fair and equitable; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and.on behalf of the State of Texas for the purpose of opening,, constructing and maintaining in conjunction with the State Highway Commissions said "Loop 289" as a designated part of the State Highway System, which land is mode particularly described as follows: A parcel of land out of Lot 1, Block �0, Morning View Addition, second installment to the City of Lubbock, -conveyed to L. E. Fleming by deed dated March 7, 1956, and recorded in volume 389,. page 584, of the deed records of Lubbock County, Texas,, being more particularly described as followst BEGINNING at the Northeast corder !of said Lot 1; THENCE South along the East boundary line of said Lot? 290 feet to the Southwest corner; THENCE West along the South boundary line 55. 6 feet to a point in the 'fifTest right of way line of a,proposed freeway, said point being 205. 6 feet We st of and at rlght� angle s to the centerline of said freeway as established in the field by the Texas Highway Department; I 3 THENCE North 3052. 51 East, 290. 7 feet to a point in the North boundary line of said Lot; THENCE East 35. 7 feet to the'PLACE OF BEGINNING and con- tains 0. 304 acres. THAT the owners of said land be offered through the Right of Way Depart- ment, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated: for the ,use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
