Said Letter of Award is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. Texas 79457 (806) 775-2167 • Fax (806) 775-2164 May 26, 2000 Mr. Bernard Bailey Bailey's House of Guns 3626 Bluebonnet Drive Houston, TX 77053 RE: BID #00-083 — Training & Duty Ammunition —Annual Pricing Dear Mr. Bailey: Bailey's House of Guns has been awarded the following category of items of the above -referenced bid: .40 S&W Training Ammunition, .approximately 60,000 Each at $.12121; 9mm Luger Duty Ammunition, approximately 2,000 each at $.18041. Purchase orders will be issued by the City of Lubbock and covers the category of Items shown below, and no other, during the period beginning June 15, 2000 and ending June 14, 2001. The purchase order number must be on the Invoice sent to the City of Lubbock for payment. The City of Lubbock shall not be responsible for payment of any invoices except those orders placed pursuant to this agreement. Bailey's House of Guns' bid dated April 20, 2000 is incorporated into and made a part of this agreement. Prices are as quoted. All invoices shall be directed to: City of Lubbock Accounts Payable PO Box 2000 Lubbock. TX 79459 The City of Lubbock reserves the right to enforce the performance of this contract in any manner proscribed by law or deemed to be in the best interest of the City of Lubbock in the event of breach or default of this agreement. The City of Lubbock reserves the right to terminate this agreement with a thirty day written notice in the event Bailey's House of Guns fails to perform in accordance with their proposal dated April 20, 2000. No. 0151, 0152, 0153, 0154 Linda, We have come full circle in the past two months on Letters of Award. Previously, our office had been signing Letters of Award once the bid was approved by council, because they are not contracts. Bill de Haas instructed us two months ago, that for future bids, Letters of Award would require a resolution and need to be signed by himself and the Mayor. Therefore, based upon that instruction, we requested four resolutions for Bid #00-083. Last week, we have had a reversal in the procedure for Letters of Award by Bill de Haas advising that Letters of Award are not contracts and do not have to be signed by the Mayor or himself. The resolutions were obtained prior to Bill's latest instruction. Since we have received a change in the policy again, the letters have gone out from our office signed by the buyer only, not requiring the Mayor's signature. Please advise how you want to handle this. We can provide you copies of the letters that were mailed for the resolutions, or rescind the resolutions. >>> Linda Hart 07/03/00 10:14AM >>> Our records indicate that the original four (4) Letters of Award attached to Resolution No. 2000-R0151, No. 2000-R0152, No. 2000-R0153, and No. 2000-R0154 are missing from our resolution folders. These four letters are associated with BID #00-083, training & duty ammunition (annual pricing -police). Please notify our office of the status of the original Letters of Award.
