RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute on behalf of the City of Lubbock an Interlocal Cooperation
Agreement, and any associated documents, for epidemiological consulting by and
between the City of Lubbock and the Texas Tech University Heath Sciences Center,
which Agreement is attached hereto and which shall be a part of this Resolution as if fully
copied herein in detail.
Passed by the City Council this 25th day of May , 2000.

COUNTY OF Lubbock
INTERGOVERNMENTAL COOPERATION CONTRACT
THIS CONTRACT AND AGREEMENT is entered into by and between a State Agency and a
municipality shown below as Contracting Parties, pursuant to the authority granted and in
compliance with the provisions of "The Intergovernmental Cooperation Act," Texas Government
Code 791.001 et seq.
I. CONTRACTING PARTIES
The Receiving Agency: City of Lubbock Health Department
The Performing Agency: Texas Tech University Health Sciences Center
H. STATEMENT OF SERVICES TO BE PERFORMED:
Epidemiological Consulting throughout the year FY 2000 Title V Population -Based Project.
III. BASIS FOR CALCULATING REIMBURSABLE COSTS:
Method of reimbursement is based on 15% of Salary and Fringe for Dr. Ronald Warner and the
number of hours or Units of Service is 15% of time.
IV. CONTRACT AMOUNT:
$10,188.00 Salary and $2,445.00 Fringe for total of $12,633.00
V. PAYMENT FOR SERVICES:
Payment will be monthly except September, 1999 through current month will be paid
immediately.
VI. TERM OF CONTRACT
This contract is to begin September 1. 1999 , and end August 31, 2000 Either party
may terminate this contract at any time, with or without cause, by giving thirty (30) days written
notice to terminate. This agreement shall terminate immediately upon nonpayment.

VII. INDEPENDENT CONTRACTOR STATUS
Nothing in this agreement is intended nor shall be construed to create an employer/employee
relationship between the contracting parties. The sole interest and responsibility of the parties is
to ensure that the services covered by this agreement shall be performed and rendered in a
competent, efficient, and satisfactory manner.
VIII. SEVERABILITY
If any term or provision of this agreement is held invalid for any reason, the invalidity of that
section shall not affect the validity of any other section of this agreement provided that any
invalid provisions are not material to the overall purpose and operation of this agreement. The
remaining provisions of this agreement shall remain in full force and shall in no way be
effected, impaired, or invalidated.
IX. ASSIGNMENT
Neither party shall have the right to assign or transfer their rights to any third parties under this
agreement.
X. VENUE
This agreement shall be governed by and construed and enforced in accordance with the laws of
the State of Texas. Venue will be in accordance with the Texas Civil Practices and Remedies
Code and any amendments thereto.
M. AMENDMENT
This agreement may be amended in writing to include any provisions that are agreed to by the
contracting parties.
MI. DISPUTE RESOLUTION
If applicable, the dispute resolution process provided for in Chapter 2260 of the Texas
Government Code shall be used by Texas Tech University Health Sciences Center and the City
of Lubbock, to attempt to resolve all disputes arising under this contract.

THE UNDERSIGNED CONTRACTING PARTIES do hereby certify that, (1) the services
specified above are necessary and essential for activities that are properly within the statutory
functions and programs of the affected agencies and local governments of Texas, (2) the proposed
arrangements serve the interests of efficient and economical administration of the State
Government, and (3) the services, supplies or materials contracted for are not required by Section
21 of Article 16 of the Constitution of Texas to be supplied under contract given to the lowest
responsible bidder. Any payments required by this contract shall be made from current funds
available to the paying party.
RECEIVING AGENCY further certifies that it has authority granted in Texas Department
of Health Document No. 7560005906 2000 Att. No 05:BCH-Population Based Services to
contract for Epidemiological Consulting_.
PERFORMING AGENCY further certifies that it has authority to perform the services
contracted for by authority granted in.
