Carver - 2 Tracts, Best Scan Available - 04/02/1958 �. 04OZ& `, FOS: b 3/31�58 RESOLUTION WHEREAS, the City of Lubbock owns certain property hereinafter �' more particularly described which was acquired in connection with Avenue North Drive right of way; and, WHEREAS, the City Commission finds that the land hereinafter described is in excess of that needed for right-of-way purposes and constitutes surplus lands; and, WHEREAS, the City Commission finds that M. E. Carver desires to ii purchase said land and has offered the sum of $2151. 76 as the purchase price I therefor; to be paid by paying one-third in cash and the execution and delivery of one promissory note in the sum of $1400 payable in installments of $27. 07 per month to amortize the payment of such note over a period of five years from date at the rate of six per cent interest; and, WHEREAS, the City Commission finds that it is expedient and to the public interest to sell said land to M. E. Carver; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor BE and he is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Warranty Deed from the City to M. E. Carver conveying the following described land, to-wit: TRACT 1 - Part of Lots 16-24 of Block 34, Easley Subdivision of ' r3lock SS nd 34, Roberts and McWhorter.Addition to the City of . Lubbock, described by metes and bounds as follows: BEGINNING at the Southwest corner of Lot 16 of said Block 34; THENCE East 50. 74 feet to a point; THENCE North 009t and-39" West a distance of 307. 36 feet to a point in the South boundary line of .Santa Fe R. R. Right of Way; THENCE Northwesterly along the said SantaFe R. R. Right of Way line a distance of 59.47 feet to a point in the West boundary line of said Block 34; THENCE South along the West boundary line of said Block 34 a distance of 339. 7 feet to the PLACE OF BEGINNING, TRACT 2 Part of Lots 22-27, ,Easley Subdivision, of Block 31, RoUeertTs and McWhorter Addition to the City of Lubbock, described by metes and bounds as follows BEGINNING at a point 20 feet North of the Southwest corner of Lot 22; THENCE North along the West boundary line of said Block 31 a distance of ZOO feet to a point in the West boundary line of Lot 27; A- fl a II N THENCE East a distance of 31. 1 feet to a point in the West ROW line of Avenue Q North Drive; THENCE Southwesterly along the West line of Avenue Q North Drive a distance of 148.5 feet to a point; �i THENCE continuing Southwesterly along Avenue Q North Drive ROW line a distance of 53. 53 feet to a point; THENCE West a distance of 14.88 feet to the POINT OF BEGINNING. Said Deed to contain a restrictive covenant and waiver of the rights of access from said property to North Avenue Q, to be delivered to Carver upon payment j to the City of Lubbock of the sum of $751. 76 in cash and delivery of his note in the amount of $1400 bearing interest at the rate of 6% per annum and amortized over a period of five (5) years to ',be paid monthly in installments of $27. 07 each. SECTION Z. THAT the City Secretary is, hereby authorized and directed to attest the signature of the Mayor of the City of Lubbock to said deed and in evidence of the attestation the seal of the City (.of Lubbock is to be affixed thereto. Carver; Promissory note to be executed by Mr. Carver in the amount of $1400, and Deed of Trust to be executed also by Mr. Carver, and Resolution authorizing Mayor to execute said Deed. The date the first installment is due is left blank on the Warranty Deed, note and Deed of Trust (second page) - this date should be filled in on all three instruments and they should all bear the same date of execution.
