HomeMy WebLinkAboutResolution - 2000-R0113 - Amendment To Interlocal Agreement - LECD - PSAP - 04_27_2000Resolution No. 2000-R 0113 April 27, 2000 Item No. 16 RESOLUTION WHEREAS, the City of Lubbock did enter into an Interlocal Agreement with Lubbock Emergency Communication District ("LECD") on April 6, 2000 for the provision of enhanced 9-1-1 emergency service to the citizens of Lubbock; and WHEREAS, City and LECD are desirous of amending the said Agreement to provide for the establishment of an additional Public Safety Answering Point (PSAP) and the installation of related equipment; and WHEREAS, the LECD Board of Managers and the City, pursuant to the provisions of the Interlocal Cooperation Act, Texas Government Code Chapter 791.01 et.Seq., as amended, have determined that it would be in the best interests of the LECD and City and of the citizens and inhabitants of Lubbock County, Texas, to provide for the establishment of an additional Public Safety Answering Point (PSAP) and the installation of related equipment; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby is authorized and directed to execute on behalf of the City of Lubbock the Amendment to Interlocal Agreement which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. A , City Secretary APPROVED AS TO CONTENT: Steve Hailey Fire Chief APPROVED AS TO FORM: Assistant City JMK:cp Cityatt/John/LECD-Amendment.res April 10, 2000 Resolution No. 2000—R0113 April 27, 2000 Item No. 16 AMENDMENT TO INTERLOCAL AGREEMENT STATE OF TEXAS COUNTY OF LUBBOCK This amendment, (the "Amendment"), effective as of the ) V day of , JU ,L , 2000 ("Effective Date"), is by and between the City of Lubbock, ("City"), a Texas municipal corporation, and Lubbock Emergency Communication District ("LECD"). WITNESSETH WHEREAS, the City did enter into a Interlocal Agreement (Original Agreement) with LECD on April 6, 2000 for the provision of enhanced 9-1-1 emergency service to the citizens of Lubbock; and WHEREAS, City and LECD are desirous of amending the said Agreement to provide for the establishment of an additional Public Safety Answering Point (PSAP) and the installation of related equipment; and WHEREAS, the LECD Board of Managers and the City, pursuant to the provisions of the Interlocal Cooperation Act, Texas Government Code Chapter 791.01 et.Seq., as amended, have determined that it would be in the best interests of the LECD and City and of the citizens and inhabitants of Lubbock County, Texas, to use the emergency communication systems of the LECD; NOW THEREFORE, for and in consideration of the terms, covenants and conditions set forth in this Agreement, the City and LECD hereby agree as follows: ARTICLE I. ORIGINAL AGREEMENT The Original Agreement is set forth as Exhibit "A" attached and incorporated herein by reference as if fully set forth here. ARTICLE II. EQUIPMENT LIST The LECD will purchase Enhanced 9-1-1 Telephone Customer Premises Equipment, which includes call answering equipment, hereinafter referred to as CPE; Instant Call Check Records for instant playback of both Telephone and Radio conversations hereinafter referred to City of Lubbock/Lubbock Emergency Communication District (LECD) Amendment as IRR; 24 hour Logging Records for the continuous recording of both radio and telephone conversations, herein after referred to as LOGGING RECORDER; Synchronization Clocks which will keep the time on the CPE, IRR and LOGGING RECORDER precise and accurate hereinafter referred to as CLOCKS. ARTICLE III. SITE LOCATION At no charge to the LECD, the City by and through its Fire Department, will provide a suitable site for the installation, operation, and maintenance of the aforementioned equipment. Said site shall meet all specifications of the LECD for the installation, operation, and maintenance of the aforementioned equipment. ARTICLE IV. MISCELLANEOUS All other provisions contained in the Original Agreement shall remain in full force and effect and not be affected by this Amendment. EXECUTED as of the Effective Date hereof.
