WHEREAS, the City Commission of the City of Lubbock has heretofore
determined and now finds that due to increased vehicular traffic on the streets
of the City of Lubbock it is necessary to widen 38th. Street between Avenues R
and S; and,
WHEREAS, it has been further determined by the City Commission that in
order to widen 38th Street between Avenues R and S it is necessary to acquire
fee simple title to the property abutting and adjacent to the North right-of-way
line of 38th Street as presently dedicated, said land being more particularly
described hereafter by metes and bounds; and,
WHEREAS, the City Commission has heretofore had the land appraised by
an independent appraiser; and based on the appraisal has offered the sum of
$14, 410. 00 as the value of the land and damages to Mr. and Mrs. C. ;R. Gaddis
as owners of the land required for widening 38th Street in order to purchase
the same for right-of-way purposes; and,
WHEREAS, Mr. and Mrs G. 5. Gaddis have rejected the offer made by
the City of Lubbock; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
k SECTION 1. THAT public necessity and convenience requires the widening
of 38th Street and the acquisition for such purpose of the South 31. 75 feet of
the following described parcels of land, to-wit:
Parcel No. 1
Being out of the Northeast 1/4 of Survey 10, Block B, Lubbock
County, Texas, described by metes and bounds as follows:
BEGINNING at a point 1320 feet South and 1320 feet West of the
Northeast corner of said ,Survey 10, Block B, for the place of
beginning of the herein described tract of land;
THENCE North 95 feet;
THENCE East 180 feet;
THENCE South 95 feet;
THENCE West 180 feet to the PLACE OF BEGINNING, as recorded
in deed recorded on September 1, 1936, in Volume 197, page 495,
Deed Records, Lubbock County, Texas; SAVE AND EXCEPT that
heretofore conveyed on May 1, 1951, and being a 15 foot alley as
described in the deed recorded in Volume 439, page 607, and on
July 30, 1951, and being a 25 'foot strip off the West side of the
above-described land as described in the deed as recorded in
Volume 449, page 125, Defied Records, Lubbock County, Texas.

Parcel No. 2
II Being out of the Northeast 1/4 of Survey 10, Block B, Lubbock
County, Texas, as described by metes and bounds as follows:
BEGINNING at a point 1320 feet South and 1140 feet West of the
Northeast corner of said Survey 10, Block B, Lubbock County,
Texas for the beginning point of the hereinafter tract of land;
THENCE East 90 feet;
THENCE North 95 feet;
THENCE West 90 feet;
THENCE South 95 feet to the POINT OF BEGINNING, as
N described in deed recorded September 12, 1937, Volume 202,
page 385, Deed Records of Lubbock County, Texas.
And in addition to the above-described 31. 75 foot strip of land
a strip of land 6.7 feet in width abutting the above-described land
along the south side of the above-described property, which is:--mow
being:nccm#ed by Mr. and Mrs. C. SP. Gaddis.
SECTION 2, The offer of $14,410. 00 for the value of the land and damages
having been made to Mr. and Mrs. C. 0.. Gaddis as owners of the above-described
land for the purchase thereof and said offer being rejected by said owners, the
City Attorney shall be and he is hereby authorized and directed to acquire by
condemnation proceedings the fee simple title to said property heretofore descn-
bed for street purposes.
