RESOLUTION
IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Addendum No. 2
to the Airline Lease Agreement between the City of Lubbock and Rocky Mountain
Airways d/b/a Continental Express, attached herewith, which shall be spread
upon the minutes of the Council and as spread upon the minutes of this Council
shall constitute and be a part of this Resolution as if fully copied herein in
detail.

ADDENDUM NO. 2
TO AIRLINE LEASE AGREEMENT
BY AND BETWEEN
THE CITY OF LUBBOCK, TEXAS,
AND
ROCKY MOUNTAIN AIRWAYS, D/B/A
CONTINENTAL EXPRESS
WHEREAS, the CITY OF LUBBOCK, TEXAS, hereinafter referred
to as "City," and ROCKY MOUNTAIN AIRWAYS, d/b/a CONTINENTAL
EXPRESS, hereinafter referred to as "Lessee," entered into a
Lease Agreement on May 1, 1990, for space and facilities at the
Lubbock International Airport; and
WHEREAS, Lessee requested that it be allowed to relocate
its ticketing operations at the Airport; and
WHEREAS, the Airport Board of the City believes that such
relocation would be in the best interest of the citizens of the
City and recommends that the City Council of the City approve
of the relocation by authorizing the Mayor to execute this
Addendum to the May 1, 1990 Agreement;
NOW THEREFORE, the Certificated Passenger Airline Lease
hereinabove referred to is hereby amended as follows:
1. Article II, Section 2.01 is hereby amended to read as
follows:
Section 2.01 - Description of Exclusive Leased Premises.
The Exclusive Leased Premises shall consist of
3,543 square feet, more or less, in the terminal
building of the Airport.
2. The first sentence of Article VII, Section 7.01 is hereby
amended to read as follows:
Rental for the 3,543 square feet of exclusive
leased space within the terminal building of the
Airport, as described in Section 2.01, shall consist
of a fixed fee of $5.63 per square foot per year (to
cover debt service) and a variable sum for
Maintenance and Operation (M & O) costs.
3. Notwithstanding the date on which this Addendum is
executed, Lessee herein agrees to pay City rentals for the
3,543 square feet of exclusive leased space referred to in
Amended Sections 2.01 and 7.01 as though this Addendum had
been executed and became effective on October 1, 1992.
4. The new location of the Exclusive Leased Premises herein
leased to Lessee shall be designated and set forth on
Exhibit A attached hereto and by this reference made a
part of this Addendum for all purposes.
5. All other terms and conditions of the Agreement entered
into between the City and Lessee on May 1, 1990, except as
modified above and by Addendum No. 1 executed by both
parties hereto on or about September 24, 1992, shall
remain in full force and effect to the extent permitted by
law.
