WHEREAS, the City of Lubbock and the State of Texas, by and through
the State Highway Commission, have entered into a contract as empowered
and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing
for the location, construction and maintenance of that part of the State
Highway system, which has heretofore been designated as Loop 289 by the State
Highway Commission; and,
WHEREAS, under the terms of the contract the procurement and acquisition
of the necessary land needed for road right of way purposes is the obligation
of the City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in order
to make certain highway improvements in connection with said "Loop 289"
situated in and adjacent to the City of Lubbock and to the end that this
purpose be accomplished, the necessity of which is hereby confirmed by the
City Commission of the City of Lubbock, it is necessary that fee simple title
to the land hereinafter described be acquired by the City of Lubbock in
fulfillment and satisfaction of its contractual obligations to the. State of
Texas; and,
WHEREAS Terminal Building Corporation and South Plains Electric Corp.
own or have some character interest in land needed for the location, construc-
tion and maintenance of said Loop 289, and the value and total damages to the
owners for the fee simple title to said land have been appraised in the amount
" of $27,,670.00 and the Commission finds said amount to be fair
and equitable; NOW THEREFORE:
BE IT RESOLVED BY THE CITY CO41IISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated in
Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf
of the State of Texas for the purpose of opening, constructing and maintaining
in conjunction with the State Highway Commission, said "Loop 289" as a
designated part of the State Highway System, which land is more particularly
described as follows:
A parcel of land out of Section 37, Block AK, GC&SF Railway Company Survey,
conveyed to Terminal Building Company by deed dated 30 Nov. 159, and recorded
in vol. 771, page 420 of the Deed Records of Lubbock County, Texas, and
being more particularly described as follows: BEGINNING at the point of
intersection of the east boundary line of Section 37, and the North right-of-
way line of the P&SF Railroad, said point is 3360 feet South of the Northeas
corner; THENCE S 53`54, W, along said railroad right-of-way line, 340.3 feet
THENCE N 11*57' W, 948.3 feet; THENCE N 20°06.' W, 893.8 feet; THENCE East
319.4 feet; THENCE S 20°06' E, 784.2 feet; THENCE S 29*30' E, 120.0 feet;
THENCE N 60°30' E, 98.4 feet; THENCE East 45 feet to the East boundary line
of Section 37; THENCE South 774.4 feet to the place of beginning and contain
13.590 acres of which 0.725 acres have been previously obtained for use as a
county road.

THAT the owners of said land -be offered, through the Right of Way
Department, the amount appraised as the value and total damages for the fee
simple title and acquisition of said land for the purposes herein stated,
for the use and benefit of the City of Lubbock and State of Texas, and
unless accepted forthwith the City Attorney is hereby authorized and instruc
11 ted to institute condemnation proceedings to acquire the fee simple title
to said land as hereinabove described for highway purposes.
